<br /> <br /> Of Report Number: <br /> NAgenda Section: VI H <br /> SA4DDN Report Date: 8/17/2006 <br /> the city that works for YOU Council Meeting Date: 8/22/2006 <br /> <br /> 0 REQUEST FOR COUNCIL CONSIDERATION <br /> <br /> ITEM DESCRIPTION: Vacation of existing easements (EV2006-001) in the area known as Tract 1 <br /> within the Northwest Quadrant. <br /> DEPARTMENT HEAD'S APPROVAL: Grant Fernelius, Community Development Director <br /> <br /> CITY MANAGER'S APPROVAL: <br /> <br /> No comments to supplement this re o ~'L Comments attached <br /> <br /> Recommendation: Waive the reading and adopt the attached Resolutions vacating eight (8) <br /> existing easements located in the area known as Tract 1 within the Northwest Quadrant, <br /> exclusively on the west side of Old Highway 8 NW. <br /> <br /> Legislative History: August 9, 2006: Publication of a public hearing notice within the New <br /> Brighton Bulletin. <br /> <br /> Financial Impact: None <br /> <br /> Explanation: As part of the redevelopment efforts on the west side of Old Highway 8 NW <br /> within the Northwest Quadrant a number a new lots and blocks, outlots, and right-of-way <br /> dedications must occur through the preliminary and final plat process defined within Chapter 26 <br /> of the City Code. The City is currently processing a final plat known as Long Lake Landing, <br /> consisting of all land within Tract 1 of the Northwest Quadrant including the southern 6 acres of <br /> Midwest Asphalt. In order to facilitate this platting process, and ultimately sale of the land to the <br /> developers, eight existing easements must be vacated. These easements consist of sanitary <br /> sewer, utility, and ingress and egress and are no longer necessary as new easements are dedicated <br /> as part of the final plat process. <br /> <br /> The formal easement vacation process requires that the Council hold a public hearing and vacate <br /> all necessary easements by Resolution. The eight Resolutions attached reference the type of <br /> easement being vacated and the legal description of that easement and/or the document number <br /> under which it was originally recorded as.
