<br />~ <br /> <br />(.' <br /> <br />RESOLUTION NO. 86-59 <br /> <br />STATE Of MINNESOTA <br />COUNTY Of RAMSEY <br />CITY Of NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS Of fACT AND APPROVING VN-241. <br /> <br />WHEREAS, an application for a varIance has been made by DavId Rubash; <br /> <br />and <br /> <br />WHEREAS, the procedural history of the application Is as follows: <br /> <br />1. That an application for a varIance was fIled wIth the City on <br />May 29, 1986. <br /> <br />2. That the Planning CommissIon, pursuant to publIshed and mailed <br />notices, held a public hearing on June 17, 1986, all persons <br />present at the hearIng were given an opportunIty to be heard. <br /> <br />1: <br />ii <br />:' <br /> <br />3. That the applicatIon for variance approval was reviewed by the <br />CIty Council on June 24, 1986 and that the comments and <br />analysis of Staff and the Planning Commission minutes and <br />recommendations were considered. <br /> <br />!' <br /> <br />\: <br /> <br />NOW THEREfORE BE IT RESOLVED by the CIty CouncIl that the following <br />I! findings of fact are made In respect to VN-247: <br /> <br />i: <br /> <br />Ii 1. That the property Is zoned R-l, single family resIdentIal. <br /> <br />2. That the required front yard setback in an R-l zoning is 30 feet. <br /> <br /> 3. <br />, : <br />; <br />;i <br />i' 4. <br /> I <br />I <br /> 5. <br /> 6. <br /> <br />That the applicant is requesting a 13 foot 9 inch variance to <br />reconstruct and expand the existing garage. <br /> <br />That the site is in an area that was originally platted for <br />cottage development with small lots and narrow streets. <br /> <br />That the location of the existing home does not allow improvements <br />to the front of the home withIn the required front yard setback. <br /> <br />That reconstruction and expansIon of the garage wIll improve the <br />existing site by providing additional off-street parking along a <br />road that is substandard In width. <br /> <br />7. That the placement of the garage expansion will protrude into the <br />front yard setback less than the existing garage. <br /> <br />8. That the applicant will suffer undue hardship If the variance <br />Is denIed because the applicant would not be permitted to make <br />Improvements to the existing home. <br /> <br />; , <br />)! <br /> <br />9.
