<br />'r .! <br /> <br />RESOLUTION NO. 86-39 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />;: <br />I: <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING OF PL-147 (SEMINARY <br />jiESTATES) . <br /> <br />. WHEREAS, an application for preliminary plat approval has been made by <br />;Unlted Theological Seminary; and <br /> <br />WHEREAS, the procedural history of the application Is as follows: <br /> <br />f; <br /> <br />1. That an application for preliminary plat approval was filed with the <br />City on March 31, 1986. <br /> <br />2. That the Planning Commission, pursuant to published and mailed <br />notices, held a public hearing on April 15, 1986, all persons present <br />at the hearing were given an opportunity to be heard. <br /> <br /> <br />3. That the application for preliminary plat approval was considered by <br />the City Council on April 21, 1986, and that the comments <br />and analysis of City Staff and the Planning Commission minutes and <br />recommendations were considered. <br /> <br />NOW THEREFORE BE IT RESOLVED by the City Council that the following <br />Findings of Fact are made in respect to PL-147: <br /> <br />I. That the property is zoned R-I, single family residential. <br /> <br />" <br />., <br /> <br />2. That the area of the plat is 23.64 acres. <br /> <br />; <br /> <br />i; <br /> <br />3. That the site is presently part of the United Theological Seminary <br />campus and is proposed for 60 single family lots. <br /> <br />4. That the preliminary plat meets the subdivision requirements of <br />Chapter 26 of the City Code. <br /> <br />BE IT FURTHER RESOLVED that the application PL-147 is and hereby <br />approved subject to the fOllowing conditions: <br /> <br />1. That all lots be at least 75 feet wide at the building setback line. <br /> <br />J, <br /> <br />2. That all structures currently existing on the proposed Seminary <br />Estates plat conform to the R-I zoning district setbacks. <br /> <br />j; <br /> <br />3. That all driveways be located a minimum of five feet from the <br />property line. <br /> <br />4. That the street names be designated as follows: <br /> <br />Seminary Drive, Yanktown Lane, Mission House Lane <br />and Mission Court <br /> <br />5. That there be a water storage easement in the area of the pond on <br />Lots 8 and 9, Block 2. <br /> <br />6. That drainage easements be dedicated from the cul-de-sacs on Mission <br />Court and Seminary Drive to Driftwood Drive. <br /> <br />7. That 10 foot utility easements be dedicated along the frontages or <br />rear of all lots for underground cables. <br /> <br />ji <br /> <br />8. That all corner lots with frontage on 5th Street NW shall access onto <br />the proposed new streets, not 5th Avenue NW. <br /> <br />:i. <br /> <br />I <br />., <br />
