<br />RESOLUTION NO. 86-28 <br />-_...............- <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING VARIA~CE VN-244 <br /> <br />WHEREAS. an application for a Variance VN-244 has been made by <br />Harstad Companies to Dermit the construction of an office building of three <br />(3) stories; and <br /> <br />'I <br />I, <br /> <br />WHEREAS, the precedural history of the application is as follows: <br /> <br />1. That an application for a Variance, VN-244 was filed with <br />the City on November 26. 1985. <br />2. That the Planning Commission. pursuant to published and mailed <br />notices, held a public hearing on December 17. 1985. all person s <br />present at the hearing were given an opportunity to be heard. <br />3. That the application for a variance was reviewed by the City <br />Council on January 28. 1986. and that the comments and analysis <br />of staff and the Planning Commission Minutes and recommendation <br />were considered. <br /> <br />NOW THEREFORE BE IT RESOLVED by the City Council that <br />findings of fact are made in respect to VN-244: <br /> <br />the fa 11 ow; ng I <br /> <br />I <br /> <br />approved <br /> <br />7. <br />8. <br />9. <br />. , <br />10. <br />11. <br /> <br />1. That the property consists of 4.41 acres of which 1.55 acres <br />are a pond that serves surrounding properties. <br />2. That the existence of the pond causes a hardship in that full <br />zoning compliance would prevent a reasonable use of property. <br />3. That the setbacks. buffering and building quality should ensure <br />that adjacent rroperties will not be negatively impacted. <br />4. That the variance provides for an efficient use of property. <br />5. That although the building is three stories it is within the <br />height limits of the B-1 zoning district. <br /> <br />BE IT FURTHER RESOLVED that the application VN-244 is and hereby I.. <br />subject to the following conditions: . <br /> <br />1. Approval of the Rice Creek Watershed District. i <br />2. Approval of all drainage and utilities by the City Engineer. ! <br />3. Approval of the City Engineer and Ramsey County for the drive- I <br />way location and possible Silver Lake Road easement. . <br />4. Conformance with site, landscape and building plans submitted. 1 <br />5. That the landscape plan include as many of the existing trees ar <br />possible. include new minimum twelve foot evergreen trees and I <br />that additional landscaping be planted as a buffer along the , <br />West property line; should the city desire to have the appli- I <br />cant's landscape plans reviewed by an outside landscape ! <br />architect, the applicant shall reimburse the city for any cost I <br />incurred for such review.
