Leonard noted that much effort went into the preparation of this signal, <br />but an appeal process would require its removal from the contract. Proper said the <br />appeal process is called a Variance Board and is unsure whether this would qualify as <br />a variance, but will investigate. Benke feels deleting the signal is not logical, but the <br />appeal's intent is driven by appropriate cost allocation. Gunderman asked if the <br />signal portion could be rebid. Proper feels a different contract for the signal may <br />present coordination problems and increased engineering costs. He confirmed that <br />increased signal costs are being seen in many other projects. <br /> <br />Williams verified that local funds are incorporated into the 5-year street improvement <br />plan, and upcoming projects will be reviewed during the 5~year plan process. He <br />strongly believes that the project's outcome should be 100% satisfaction. Benke <br />verified that the 7th St. project will be completed before the Silver Lake Road project <br />begins. Leonard asked the City to submit names to sit on the communications board. <br /> <br />Motion by Williams, seconded by Samuelson, to WAIVE THE READING AND <br />ADOPT THE RESOLUTION TO CONCUR IN THE A WARD OF THE BID <br />FOR THE SILVER LAKE ROAD RECONSTRUCTION PROJECT 91-1 TO <br />THE LOW BIDDER, C. S. MCCROSSAN CONSTRUCTION. <br /> <br />5 Ayes - 0 Nayes, Motion Carried. <br /> <br />Proper presented the ROW easements for 5th Ave. NW Streetscaping and <br />Rehabilitation Project 95-04. <br /> <br />Thirteen of the 16 property owners have signed purchase agreements agreeing to sell <br />ROW easements to the City at $3.00 per sq. ft. Three remaining easements are <br />needed for the project and staff continues to meet with the owners. Staff hopes to <br />have these agreements by the June 27 meeting, and the project will begin in August. <br /> <br />Motion by Gunderman, seconded by Williams, to APPROVE THE PURCHASE OF <br />THE RIGHT-OF-WAY EASEMENTS FOR THE 5TH AVENUE <br />STREETSCAPE AND REHABILITATION PROJECT, PROJECT 95-04. <br /> <br />5 Ayes - Nayes, Motion Carried. <br /> <br />Mattila presented the administrative appeal for lnnsbruck Park Estates Ponding area. <br /> <br />The property is located west of 27th Ave. between 1-694 and 12th St. NW. The <br />applicant, Harstad Homes, proposes to eliminate a ponding area (Pond 2) located <br />between the townhomes and two single family homes. The ponding area was included <br />in the original 1991 drainage plan approved by the RCWD and Council. According <br />to Harstad, the two easterly lots along the north side of Linden Dr. are unmarketable <br />due to the drainage pond behind them. Harstad's revised drainage plan would <br />increase the depth of Pond 3/4 located in the City park. According to Harstad's <br />engineer, Ulteig Engineering, the elimination of Pond 2 would not have a negative <br />impact on drainage patterns.
