He feels that silt from this area which runs into Pond 3/4 may work <br />against Pond 3/4's ability to hold water, and supports some modification to Swale 2 to <br />remedy the current situation. He is somewhat concern of Pond 5, but is comfortable <br />with mediation for Swale 2. Harstad suggests the orifice be opened at Swale 2 and <br />then studied after a heavy rainfall to see if Pond 5 has problems. Harstad wants the <br />area to be nice just as much as the Council. <br /> <br />Benke asked if Proper intents to install a lO-inch orifice. Proper said the Ulteig Plan <br />lists both 9 and 10 inch orifices and does not know their response. Melcher said <br />RCWD approved the 9-inch orifice and this could work, but installation of a 10 inch <br />could be discussed. Benke noted the two sets of calculations and feels that before the <br />Council is comfortable with regrading Swale 2, the data needs to be reanalyzed. <br />Melcher and Harstad feel a lO-inch orifice should be installed and if that doesn't <br />work they could come back and discuss increasing the pond size. <br /> <br />Proper agrees that the calculations need to be reevaluated. Fulton recommends that <br />the lO-inch orifice be installed in Pond 3/4 and an agreement be entered into where <br />the real practical impact of a 100-year flood is the true measurement of whether the <br />system will work. If any problems occur, then both parties come back and mediate <br />financially. Harstad does not have a problem with this and feels the lO-inch orifice <br />will work. Fulton feels the Park Board should be contacted of this proposal. <br /> <br />Williams noted the need for agreement between Ulteig and staff regarding the <br />upgrade. Fulton said that assuming the orifice is installed and changes are made to <br />Pond 2, the issue relates to the overall drainage pattern. If the engineering numbers <br />are correct, Ulteig should be willing to stand behind them. Ulteig needs to determine <br />the appropriate design, and enter into an agreement whereby they are held <br />financially. Harstad feels the opening on Swale 2 is too small and increasing the flow <br />by 35 % will clear up the problem. <br /> <br />Benke suggests staff work with the applicant to resolve disagreements and come back <br />to Council on June 27. Larson asked if this recol1unendation includes that no work <br />be performed until June 27. Benke feels the area should not be regraded without an <br />agreement. Williams requests the applicant and staff determine Swale 2's regrading, <br />capacity, orifice, Pond 3/4 flow volume, and any potential affect to Pond 5. Larson <br />asked to review Pond 5 I s outlet and distribution to the stormsewer. <br /> <br />Motion by Gunderman, seconded by Williams, to REQUEST STAFF TO WORK <br />WITH THE APPLICANT TO RESOLVE THE DETAILS AND <br />DISAGREEMENTS OF THE INNSBRUCK PARK ESTATES PONDING AREA <br />AND COME BACK TO COUNCIL ON JUNE 27,1995. <br /> <br />5 Ayes - 0 Nayes, Motion Carried. <br /> <br />Council Business <br /> <br />Innsbruck Park Estates <br />Ponding Area <br />Report 95-104 <br />
