<br />Council Meeting Minutes <br />December 13, 1994 <br /> <br />Page 4 <br /> <br />Public Hearin& - Alley and Street Vacation, 6th Ave. and 9th St. - 7;38-7;40 p.m. <br /> <br />Mattila presented for consideration a request to vacate 6th Ave. NW, an alley, and <br />9th St. NW in the downtown area. <br /> <br />In order to accommodate the approved Brighton Green Townhouse development, <br />staff is proposing a portion of the 6th Ave. right-of-way, all of the 9th St. right-of- <br />way and an east-west alley in the downtown area be vacated. <br /> <br />Ramsey County will not allow the approved Brighton Green subdivision to be <br />recorded until the underlying streets are vacated. <br /> <br />There were no comments from the audience. <br /> <br />Motion by Samuelson, seconded by Larson, to CWSE THE HEARING. <br /> <br />4 Ayes - 0 Nayes, Motion Carried. <br /> <br />Hearing was closed at 7:40 p.m. <br /> <br />Motion by Larson, seconded by Samuelson, to WAIVE THE READING AND <br />ADOPT THE RFSOLUTION VACATING AN EAST-WEST ALLEY, A <br />PORTION OF 6TH AVENUE NW, AND 9TH STREET NW, AS LEGALLY <br />DESCRIBED, SUBJECT TO THE FOLWWING CONDmON: <br />1. ESTABLISH EASEMENTS OVER ALL PROPOSED PUBLIC <br />UTILITY LINFS WrnnN THE BRIGHTON GREEN SUBDIVISION. <br /> <br />4 Ayes - 0 Nayes, Motion Carried. <br /> <br />Council Business <br /> <br />City Manager Matthew Fulton presented for consideration the establishment of a <br />Stormwater Utility. <br /> <br />On November 22, Council gave a first reading to adopt an ordinance establishing <br />the stormwater utility. Since the fIrst reading, staff has received two requests for <br />additional information.
