The church could be given an informal go ahead subject to staff <br />investigation. LeFevere is unfamiliar with the parcel design and is unsure how the <br />adjacent properties feel about this request. Ekberg said the parking lot would be <br />located on the eastside of Silver Lake Road and would alleviate the parking situation <br />on the northside. Proper appears questionable that the parking lot could be <br />completed before winter. Benke suggested that Council could allow sod removal <br />and application of a sub-base to allow parking, and then improvements be performed <br />next spring. Fulton said it is always difficult to allow exception to the rule, but <br />parking on the sodded area appears to not violate any nuisance code. <br /> <br />Benke said that because of publication notification requirements for the public <br />hearing notice, it appears the November 22 meeting date does not allow for adequate <br />notification. Benke would be willing to schedule a special meeting. Fulton said the <br />public hearing process is designed to receive input beyond Council. Benke <br />acknowledged the need for the hearing process, but feels the project timeline could <br />be expedited. Fulton said a schedule could be made to accommodate church needs. <br /> <br />LeFevere confirmed that the Council Agenda could be opened to provide action. <br />Benke asked if a public hearing could be scheduled on November 22. LeFevere <br />said formal action is. not needed to schedule a public hearing as long as proper <br />publication notification is provided. LeFevere suggested that Council direct staff to <br />review ordinance requirements and publication deadline specifications and then <br />direct a public hearing be schedule as soon as possible. <br /> <br />Fulton stated there is a 10 day publication requirement for legal notices; and the <br />New Briflhton Bulletin deadline has passed for this week. The next publication date <br />would be November 15, and would not provide for the 10 day requirement before <br />November 22. Assuming the notice was published on November 15, a special <br />meeting could be scheduled after November 25. Larson volunteered to contact those <br />properties adjacent to the church property. Fulton will verify the publication <br />notification requirements. LeFevere has seen public hearings where persons had <br />objected to parking lot expansions and is somewhat concerned the public hearing <br />process may be perceived somewhat incorrect. Benke recognizes the need for good <br />faith public hearing. Samuelson asked if the church has contacted the adjacent <br />properties. Jim Birch, Salem Church, will contact the adjacent properties. Birch <br />said the lot is also used for "Park and Ride" which does serve a public purpose. <br /> <br />Motion by Larson, seconded by Samuelson, to REQUEST STAFF TO WORK <br />WIm APPROPRIATE PARTIES FROM SALEM BAPfIST CHURCH AND <br />THE PLANNING COMMISSION TO EXPEDITE REQUIRED PUBLIC <br />HEARING APPROVAL FOR CONSIDERATION OF A PARKING WT <br />EXPANSION; AND IF WARRANTED AND APPROPRIATE THE <br />SCHEDULING OF A SPECIAL MEETING FOR COUNCIL <br />CONSIDERATION DURING THE WEEK OF NOVEMBER 28, 1994, <br />CONSISTENT WIm REQUIRED NOTIFICATION TIMETABLES. <br /> <br />4 Ayes - 0 Nayes, Motion Carried. <br /> <br />New Business <br /> <br />Salem Baptist Church <br />Parking Lot <br />Expansion <br />
