<br />Council Meeting Minutes <br />September 27, 1994 <br /> <br />Page 2 <br /> <br />Public Hearing - Mounds Avenue Right-of-way Vacation - 7:35-7:38 p.m. <br /> <br />City Planner Erny Mattila presented a request to vacate a portion of the Mounds <br />Avenue right-of-way. <br /> <br />The City received a petition from Cheetah Precision to vacate a portion of Mounds <br />Ave. which bisects property owned by Cheetah. Cheetah operates out of a building <br />located south of Mounds Ave., and Council approved plans to construct a second <br />building north of Mounds Ave. To combine the two sites, a portion of Mounds <br />Ave. needs to be vacated. The vacation would increase the site's size and efficiency <br />and allow Mounds Ave. to serve uses to the west. A utility easement will be <br />established for those public utilities located under that portion. <br /> <br />Williams asked if the Planning Commission reviewed the request. Mattila <br />confirmed that the Planning Commission does not review vacation requests and these <br />requests are directly considered by the Council. <br /> <br />There were no comments from the audience. <br /> <br />Motion by Williams, seconded by Larson, to CLOSE THE HEARING. <br /> <br />5 Ayes - 0 Nayes, Motion Carried. <br /> <br />Hearing was closed at 7:38 p.m. <br /> <br />Motion by Williams, seconded by Larson, to WAIVE TIlE READING AND <br />ADOPT THE RESOLUTION MAKING FINDINGS OF FACT AND <br />APPROVING VACATION OF A PORTION OF THE MOUNDS A VENUE NW <br />RIGHT-OF-WAY, SUBJECT TO THE FOLLOWING CONDITION: <br />1. ESTABLISH EASEMENTS OVER ALL EXISTING AND PROPOSED <br />UCILITY LINES WITHIN THE VACATED PORTION OF MOUNDS <br />AVENUE NW RIGHT-OF-WAY AS DESCRIBED IN RESOLUfION. <br /> <br />5 Ayes - 0 Nayes, Motion Carried. <br /> <br />Public Hearin!! - Roseville Properties/Trend Enterprises - 7:39-7:40 p.m. <br /> <br />Mattila presented for consideration the continuation of the public hearing for a <br />minor subdivision involving two industrial lots. <br /> <br />Recently, Trend Enterprises discovered that a six ft. section of their driveway was <br />located on the property owned by Roseville Properties. To resolve this situation, <br />Trend proposed a minor subdivision, however, a subdivision would then relocate <br />about 20 ft. of Roseville Properties' driveway onto the Trend property. Mattila <br />advised the property owners to redraw the survey so the property line does not <br />bisect either driveway or the fence.
