<br />I <br /> <br />I <br /> <br />I <br /> <br />Council Meeting Minutes <br />May 10, 1994 <br /> <br />Page 11 <br /> <br />Council Business. continued <br /> <br />Motion by Larson, seconded by Benke, to ISSUE A ONE DAY TEMPORARY <br />INTOXICATING LIQUOR UCENSE TO LAKE REGION HOCKEY <br />ASSOCIATION FOR JUNE 12, 1994, AT OR ABOUT 2350 PALMER DRIVE <br />(BRIGHTON VILLAGE SHOPPING CENTER PARKING WT). <br /> <br />3 Ayes - 2 Nayes (Samuelson and Gunderman), Motion Carried. <br /> <br />Announcements and Updates <br /> <br />Fulton will put together an update for the Council regarding the Senior Center. <br /> <br />Williams noted that House File 3086, the State's answer to landfill closures, is <br />presently being reviewed by the Governor. Because there appears to be no <br />controversy associated with the bill, it appears that passage is likely. Because of the <br />recent impact to New Brighton in regards to the cleanup of the Oak Grove Landfill, <br />the City has much interest in its passage. He questioned the bill's impact on the <br />amount of litigation and finger pointing that has occurred in past landfill closures. <br />Fulton said the MPCA has indicated that New Brighton should expect some <br />reimbursement as a result of the legislation. Fulton has heard that letters had been <br />mailed to parties involved in the cleanup of a landfill in Andover, but New Brighton <br />had not received one. <br /> <br />Because of the recent Minneapolis case, Gunderman requested staff to research the <br />issue of Off-Duty Police Officer exposures to the City. Fulton said that any abuse <br />of power by a Off-Duty Police Officer as it relates to its municipal function could <br />have a potential exposure to the City. Gunderman asked for review of the City's <br />liability and creation of a possible policy to limited that involvement.
