<br />I <br /> <br />I <br /> <br />I <br /> <br />Council Meeting Minutes <br />January 11, 1994 <br /> <br />Page 7 <br /> <br />Council Business. continued <br /> <br />The acquisition efforts for the redevelopment area across from City Hall include <br />parcels contaminated with chemicals that are not reimbursable from the Petro Fund. <br />Staff will need to work closely with John Drawz from Fredrikson & Byron, the <br />City's Environmental Attorney, because the full ,extent of the contamination will not <br />be known until the buildings are removed. <br />The parcels will need to be dealt with in the most comprehensive and efficient way <br />as possible to ensure the City's best interests. <br /> <br />Staff requests permission to retain Fredrikson and Byron as Environmental and <br />Acquisition Attorneys for the redevelopment projects on Site A (Rottlund and New <br />Brighton Care Center). <br /> <br />Fredrikson and Byron estimate the legal fees for the real estate, condemnation, and <br />environmental tasks to range from $12,300, if all parcels were acquired through .. <br />negotiated agreements, to a high of $16,100, if all parcels were acquired through..:. <br />condemnation. With the addition of an amount for a contingency, the total budget . <br />amount for legal fees associated with Site A is $20,000. ' <br /> <br />Motion by Williams, seconded by Gunderman, to AUTHORIZE RETAINING <br />FREDRIKSON AND BYRON FOR ACQUlSmON AND ENVIRONMENTAL <br />PURPOSFS FOR THE SITE A DOWNTOWN REDEVEWPMENT PROJECT <br />IN THE AMOUNT NOT TO EXCEED $20,000. <br /> <br />4 Ayes - 0 Nayes, Motion Carried. <br /> <br />Announcement and Updates <br /> <br />Fulton announced that the Cities of New Brighton and Fridley have received an <br />Innovations Award from the State Engineering Association for the Fridley Water <br />Interconnection Project. This award recognizes the unique approach to dealing with <br />surface water. Both cities should be congratulated for this honor. <br /> <br />Fulton explained that the City's Environmental Attorney, Barr Engineering, and City <br />staff met Tuesday morning to address mediation and cleanup concerns on the <br />MacGillis and Gibbs site. Originally, a Council Worksession was scheduled for <br />January 19, to address these concerns. However, Fulton feels that a formal <br />worksession might be more productive following a couple of more staff level <br />meetings and, therefore, recommends deferral of the worksession to a later time. <br />The expenditures needed to conduct these preliminary meetings will be about <br />$15,000 and includes legal expenses and appraisal fees. The expenditures will be <br />structured into the redevelopment framework. Formal Council action is not needed, <br />but input is requested.
