To date, no variances have been granted for canopies by the <br />Council. The Beach's Long Lake Road and Phillips 66 canopies were <br />constructed prior to the current ordinance and setbacks. <br /> <br />Gunderman feels that in the best interest in keeping good businesses in <br />New Brighton, Council should attempt to make this canopy a reality. He <br />proposes recommendation C (the current setback standards 30 feet for <br />service station canopies in business and industrial districts be amended to <br />allow for a lesser setback of 10 feet from the street right-of-way). <br /> <br />Benke suggested that staff prepare appropriate special use permit language <br />to judge canopies as special uses and modify criteria. Mattila noted that if <br />Council wishes to reduce setback requirements, an indicated set number of <br />feet for the setback is desirable. If Council wishes to require canopies as a <br />special use in both business and industrial, this should be indicated. <br /> <br />Mattila verified that the cities of Spring Lake Park and Falcon Heights <br />require that service stations canopies be considered special uses and <br />setbacks are established for each separate proposal. <br /> <br />Benke asked when would consideration be given to Smith's application. <br />Mattila said the earliest date for review by the Planning Commission is July <br />20. After that date, it would be presented to Council on July 27. <br /> <br />Williams requested staff to work with Mr. Smith to determine the minimal <br />setback which would work in the situation. <br /> <br />Greg Belting, Chamber President, said the Chamber supports the special use <br />permit for the Silver Lake Road Amoco canopy. He also congratulated <br />Childs on his new position as City Manager for the City of Minnetonka. <br /> <br />Bob Smith said the canopy would allow his business to become more <br />competitive, and thanked the Council for their support. <br /> <br />Gunderman asked if the timeframe for approval could be reduced.
