<br />I <br /> <br />Council Meeting Minutes <br />June 7, 1993 <br /> <br />Page 7 <br /> <br />Council Business. continued Council Business <br /> <br />The City Attorney advises the City to accept the presented settlement. Oak Grove Landfill <br />LeFevere noted that his firm had represented a number of other cities in the <br />lawsuit, and this arrangement allowed the legal costs to be spread among <br />those cities. If the City did not accept this lawsuit, the legal costs would <br />more likely accrue faster. <br /> <br />Williams feels the City should cut their losses and authorize the <br />settlement. <br /> <br />Benke feels the settlement should understood as being approved under <br />protest. The City needs to consider its choice of either long term legal <br />costs and risks, or accept something he perceives as being similar to <br />extortion. He feels it is outrageous that the U.S. Fish and Wildlife would <br />come in at the last moment and request $180,000. He asked the City to <br />work with its Legislators to pass future legislation on such litigation <br />matters, <br /> <br />Motion by Williams, seconded by Larson, to AUTHORIZE THE MAYOR AND <br />CITY MANAGER TO PAY $26,526 FOR THE SETTLEMENT OF THE OAK <br />GROVE LANDFILL LITIGATION WHICH INCLUDES THE AMOUNT <br />REQUESTED BY THE UNITED STATES FISH AND WILDLIFE SERVICE. <br /> <br />I 4 Ayes' 0 Nayes, Motion Carried. <br /> <br />Williams suggested that the City send a letter to the Legislators recognizing <br />their efforts and continued support.
