<br />I <br /> <br />I <br /> <br />I <br /> <br />Council Meeting Minutes <br />May 25, 1993 <br /> <br />Page 11 <br /> <br />Council Business, continued <br /> <br />Childs presented an interim ordinance relating to peddler licensing. <br /> <br />Staff was directed to prepare an ordinance preventing door-to-door sales until <br />the City could complete a re-evaluation of its procedures and policies. The <br />City Attorney drafted an ordinance addressing a temporary moratorium. He <br />noted that organizations such as the Girl and Boy Scouts would be included in <br />the moratorium. <br /> <br />LeFevere confirmed that the ordinance would repeal itself if the study was <br />not completed by the Council predetermined timeframe.Gunderman's <br />intention was to request staff to investigate the issue so that the safety of <br />children is protected from undesirable parties of questionable criminal <br />background. He feels the license fees should be modified to reflect non-profit <br />organizations located both in and out of the City. He does not have objection <br />to whether respectable organizations are non-residents, but noted concern <br />about peddlers with questionable backgrounds. <br /> <br />LeFevere and staff will report back to Council regarding their investigations <br />of Gunderman's concerns. <br /> <br />LeFevere said the basis for suspending the ordinance is so that Council could <br />determine whether peddling in residential neighborhoods is a nuisance. A <br />resident has the right to ask a peddler if they are licensed by the City. An <br />unlicensed vendor could be charged with a misdemeanor. This portion of the <br />ordinance does not affect solicitation, just the licensing issue. <br /> <br />Childs noted that there are a number of organizations, such as Green Peace <br />and Clean Water, which are not required to be licensed by the City. <br /> <br />Benke questioned whether the Citizen Study Commission should review the <br />issue. LeFevere feels that if Council has concerns regarding security, the <br />City Attorney's staff could provide advice regarding that matter. <br /> <br />Motion by Gunderman, seconded by Larson, to SET THE SUNSET DATE <br />OF 45 DAYS OR BY THE JULY 13 COUNCIL MEETING; AND <br />WAIVE THE FIRST AND SECOND READING AND ADOPT AN <br />INTERIM ORDINANCE RELATING TO THE LICENSURE OF <br />PEDDLERS, SOLICITORS, TRANSIENT MERCHANTS AND <br />HANDBILL DISTRIBUTORS; AFFECTING CITY CODE SECTION 20- <br />20 THROUGH 20-28. <br /> <br />5 Ayes - 0 Nayes, Motion Carried. <br /> <br />Council Business <br /> <br />Peddler Ordinance <br />Report 93-152 <br />
