He complimented Proper <br />on his response to prevent further runoff by placing dirt piles on 7th St. <br /> <br />Motion by Gunderman, seconded Larson, to AUTHORIZE THE CITY <br />MANAGER, BASED ON LEGAL RECOMMENDATION, TO DO WHATEVER IS <br />NECESSARY TO REMEDY THE SITUATION IMMEDIATELY; AND DIRECT <br />STAFF TO REVIEW THE PLANS AND SPECIFICATIONS TO DETERMINE <br />THE FACT THE CONTRACTOR WAS NOT IN CONFORMANCE WITH THE <br />APPROVED PLANS; AND REPEAT THE CONCERN OF THE COUNCIL <br />IMMEDIATELY TO THE APPROPRIATE CHURCH OFFICIALS THAT THIS <br />MATTER HAS REACHED THIS POINT AND REQUEST TO EXPEDITE <br />ACTION TO RESOLVE THE MATTER IMMEDIATELY. <br /> <br />5 Ayes - 0 Nayes, Motion Carried. <br /> <br />Mr. Paul Engstrom, 770 Oakwood, said in the past a majority of the runoff <br />would flow into Mr. Kozel's yard, but this time it came into his yard. He <br />complimented Proper for his help during the crisis, but found working with <br />the contractor has been very difficult. <br /> <br />Benke suggested that staff should review the construction staging process <br />of future projects more intensely. <br /> <br />Larson sympathizes with Mr. Kozel and Mr. Engstrom, and recalled that the <br />grading plan stated that the Cottonwood Trees would not be removed. <br />Mr. Engstrom said Mr. Flor. 830 Oakwood, also received damage, but could <br />not attend the meeting. <br /> <br />Childs will keep the Council updated on the situation. <br /> <br />Announcements & Ucdates - None <br /> <br />Adiournment <br /> <br />Motion by Rebelein, seconded by Larson, to ADJOURN THE MEETING. <br /> <br />5 Ayes - 0 Nayes, Motion Carried. <br /> <br />Meeting was adjourned at 10: 1 6 p.m. <br /> <br />~ <br />Robert J.
