He complimented Proper on his response to prevent further runoff by placing dirt piles on 7th St. Motion by Gunderman, seconded Larson, to AUTHORIZE THE CITY MANAGER, BASED ON LEGAL RECOMMENDATION, TO DO WHATEVER IS NECESSARY TO REMEDY THE SITUATION IMMEDIATELY; AND DIRECT STAFF TO REVIEW THE PLANS AND SPECIFICATIONS TO DETERMINE THE FACT THE CONTRACTOR WAS NOT IN CONFORMANCE WITH THE APPROVED PLANS; AND REPEAT THE CONCERN OF THE COUNCIL IMMEDIATELY TO THE APPROPRIATE CHURCH OFFICIALS THAT THIS MATTER HAS REACHED THIS POINT AND REQUEST TO EXPEDITE ACTION TO RESOLVE THE MATTER IMMEDIATELY. 5 Ayes - 0 Nayes, Motion Carried. Mr. Paul Engstrom, 770 Oakwood, said in the past a majority of the runoff would flow into Mr. Kozel's yard, but this time it came into his yard. He complimented Proper for his help during the crisis, but found working with the contractor has been very difficult. Benke suggested that staff should review the construction staging process of future projects more intensely. Larson sympathizes with Mr. Kozel and Mr. Engstrom, and recalled that the grading plan stated that the Cottonwood Trees would not be removed.
