Jacobson, Director of Public SafetV/i " <br />" I l,-, <br /> <br />CITY MANAGER'S APPROVAL: <br /> <br />No comments to su lement this re <br /> <br />V~omments attached <br /> <br /> <br />Recommendation: <br /> <br />Approval of Resolution and Consent Order Imposing a Civil Penalty of $2,000 for Barley John's <br />Brew Pub. <br /> <br />Legislative History: <br /> <br />Barley John's Brew Pub has one Council approved Consent Order from June 14,2005. <br /> <br />Financial Impact: <br /> <br />Civil penalty of $2,000 will be received within 30 days. <br /> <br />Explanation: <br /> <br />The City of New Brighton conducts alcohol compliance checks twice per year. The goal of <br />conducting compliance checks is to reduce the availability of alcoholic beverages to those who <br />are under the age of 21. <br /> <br />Barley John's Brew Pub sold alcoholic beverages to a buyer under the age of21 during police <br />supervised compliance checks on September 2,2004 and on January 26, 2005. The employees <br />who sold during those compliance checks were convicted of criminal charges for those violations <br />and, Mr. John Moore, owner of Barley John's, paid a $1,000 and a $1,500 civil penalty <br />respectively for those violations, Mr. Moore also signed a consent order for the latter violation <br />that was approved by Council on June 14,2005. <br /> <br />On November 9, 2005, an employee of Barley John's Brew Pub again sold alcoholic beverages <br />to an buyer under the age of 21 during a police supervised compliance check. The employee was <br />charged, and, eventually convicted, of the criminal violation. The civil penalty for this violation <br />includes payment of $2,000 to the City of New Brighton. <br /> <br />I have met with Mr. John Moore, owner of Barley John's Brew Pub. Mr. Moore has <br />demonstrated remorse for the sale of alcoholic beverages by his staff.
