State Statutes and City Code <br />should also provide direction. City Attorney Charlie LeFevere asked if the <br />esc recommends adoption of the State maximum fee structure. Hartlaub <br />said the fee structure should be in compliance with State Statutes, <br />however, the CSC does not recommend adoption of the maximum fees. <br /> <br />There is no change to hours of operation or location. Age limitations <br />would reference statutes. The CSC suggests the code be rewritten to <br />specify ages. Charitable gambling will reference the relevant State <br />Statutes. <br /> <br />Rebelein feels the continued referencing throughout the ordinance to State <br />Statutes becomes cumbersome. Hartlaub said the subcommittee felt that <br />referencing State Statutes requirements was the most appropriate. <br /> <br />Noise from inside or outside associated with on-sale liquor establishments <br />should reference Ordinance 578 "Parties and Gatherings". <br /> <br />The subcommittee found "Conduct" a challenge. The City of Roseville <br />possesses the only ordinance which covers the topic in the most adequate <br />way and the CSC recommends adoption of a similar ordinance. Rebelein <br />requested a copy of the Roseville ordinance. <br /> <br />Council thanked the CSC for its efforts. <br /> <br />Motion by Benke, seconded by Gunderman, to ACCEPT THE CITIZEN <br />STUDY COMMITTEE'S AMENDMENT RECOMMENDATIONS TO THE NEW <br />BRIGHTON LIQUOR ORDINANCE: REQUEST STAFF PREPARE DRAFT <br />AMENDMENTS FOR REVIEW WITH THE CSC; AND FORWARD <br />RECOMMENDATIONS TO CITY ATTORNEY FOR INCLUSION IN AN <br />AMENDED LIQUOR ORDINANCE. <br /> <br />5 Ayes ~ 0 Nayes, Motion Carried. <br /> <br />City Sanitarian David Fridgen presented the joint powers recycling <br />agreement with Ramsey County and New Brighton; and the recycling <br />contract between the City and E-Z Recycling. <br /> <br />As of January 1992, the County will no longer fund the City's recycling <br />program. The joint powers agreement provides the City a means for <br />funding in cooperation with the County. As property taxes are collected, <br />the County will send the City the appropriate monies. <br /> <br />The 1992 recycling service charge has increased from 1991 and will be <br />$15.40 per single household. The increase reflects: a decrease in County <br />funding, loss of service to apartments, higher contract price, increased <br />tonnage, and the addition of plastic recycling.
