<br />1 <br /> <br />1 <br /> <br />1 <br /> <br />Council Meeting Minutes <br />October 22, 1991 <br /> <br />Page 7 <br /> <br />Council Business. continued <br /> <br />Rebelein noted that if the amendment is adopted and then challenged, the <br />City will go to court to defend its position. <br /> <br />Regarding a public ballot, Benke said there is no provision for initiative and <br />referendum. Rebelein said that even if there was initiative and <br />referendum, the City can not enact something that is unconstitutional. <br /> <br />Larson would like a psychologist's opinion on how the signs would affect <br />a very young child. Rebelein said the pictures are very graphic and <br />suggested the contents be verbal versus visual. <br /> <br />LeFevere said the Court determined that letters to the editor do not <br />provide a substitute for a public forum. He Questions whether the City <br />can determine if the signs have a worse detrimental psychological effect <br />on an individual versus the 6:00 news. In terms of obscenity, the <br />government is authorized to impose age restrictions or limitations, <br />however, the government is limited in regards to content. The City can <br />regulate activities that pose traffic problems and restrict signs which are <br />placed on street corners. <br /> <br />Larson said a person can turn off a TV or close a book if offended by the <br />content, but the neighbors are powerless with the sign. He feels that <br />everyone involved in the issue should be treated fairly. <br /> <br />Motion by Rebelein, seconded by Williams, to WAIVE THE READING AND <br />GIVE A SECOND READING, ADOPT, AND ORDER THE PUBLICATION OF <br />AN ORDINANCE AMENDING THE NEW BRIGHTON SIGN ORDINANCE BY <br />ALLOWING FOR NON~COMMERCIAL OPINION SIGNAGE; AND DIRECT <br />STAFF TO FURTHER RESEARCH IN REGARDS TO OPTIONS FOR <br />CONTENT RESTRICTION AND DO FURTHER ANALYSIS AND RESEARCH <br />ON PUBLIC SAFETY ASPECTS. <br /> <br />5 Ayes ~ 0 Nayes, Motion Carried. <br /> <br />Announcement and Uodates <br /> <br />A dinner with the House of Representatives is scheduled on October 28 at <br />Shoreview Community Center. <br /> <br />Rep.
