The proposed plan restricts exterior signage <br />to individual illuminated neon letters and the interior signage to individual <br />non-illuminated letters. The Champps'/liquor Store involves signage for <br />all building sides plus two direction signs located south of the facility. <br /> <br />Charlie Gravelle, Kraus Anderson, will investigate the removal of the City <br />of New Brigh~on logo on the New Brighton liquors sign. <br /> <br />Motion by Williams, seconded by Larson, to WAIVE THE READING AND <br />ADOPT THE RESOLUTION MAKING FINDINGS OF FACT AND APPROVE <br />DESIGNATION OF THE CHAMPPS'/NEW BRIGHTON LIQUOR FACILITY AS <br />AN AREA OF SPECIAL CONTROL AND APPROVE SP-165. <br /> <br />4 Ayes - 0 Nayes, Motion Carried. <br /> <br />Mattila presented Belair Builders' application for site plan, special use <br />permit and setback variance to construct an 11,104 sq. ft. office/storage <br />facility and storage yard on a portion of the old Herbst landfill. The facility <br />would be located on the buildable area of the landfill. <br /> <br />The facility, off-street parking, and storage yard complies with City <br />standards. .However, a portion of the storage yard which fronts a road <br />easement would require a 40 foot variance. <br /> <br />The Planning Commission viewed the landfill as a hardship and <br />recommends approval, subject to these conditions: setback variance will <br />expire 6 months after landfill remediation or improvement of easement as <br />a public way, resolution is entered into property abstract, and landscape <br />plan is approved within 6 months after variance expiration. <br /> <br />Enforcement of the setback standard will ensure that the storage yard's <br />impact on future road development will be minimal. Mattila said a landfill <br />does not necessarily represent an undue hardship if the owner or buyer <br />had prior knowledge. <br /> <br />Mattila confirmed that the amount of material will be controllable because <br />the storage area is limited. Once MPCA allows expansion beyond the <br />western boundary, a landscape screen will be built to limit storage. <br /> <br />The Minnesota Pollution Control Agency's (MPCA) methods to effectively <br />close the landfill include: monitoring wells and establishment of a <br />protective cap over the landfill area.
