<br />I <br /> <br />I <br /> <br />I <br /> <br />Council Meeting Minutes <br />July 9, 1991 <br /> <br />Page 2 <br /> <br />Council Business <br /> <br />Erny Mattila, City Planner, presented the second reading of the <br />amendment to the Floodplain Ordinance. Council gave first reading on <br />May 28, and the State has reviewed and approved the amendment. <br /> <br />The proposed ordinance is 26 pages in length and would be costly to <br />publish. It is recommended a resolution be adopted authorizing the <br />publication of an "Ordinance Summary". <br /> <br />Rebelein questioned if the shortened summary opens the City up to <br />potential lawsuits. City Attorney Charlie leFevere said the statutory <br />authorization to publish a summary in lieu of entire publication is clear and <br />the standards are set forth. Given the nature of the Floodplain Ordinance, <br />it is unlikely the summary is discriminatory and the legal challenge is <br />minimal. Determining the ordinance's effect on an individual is one criteria <br />used in deciding upon a shortened summary. <br /> <br />Motion by Williams, seconded by larson. to WAIVE THE SECOND <br />READING AND ADOPT AND ORDER PUBLICATION OF AN ORDINANCE <br />AMENDING THE NEW BRIGHTON ZONING ORDINANCE, CHAPTER X. <br />FLOODPLAIN MANAGEMENT; AND WAIVE THE READING AND ADOPT <br />THE RESOLUTION AUTHORIZING PUBLICATION OF A SUMMARY OF THE <br />AMENDED FLOODPLAIN MANAGEMENT ORDINANCE. <br /> <br />5 Ayes - 0 Nayes, Motion Carried. <br /> <br />Mattila presented specifications for removal of four residential properties <br />within TIF No. 15 (1st Street NW) and authorization to advertise for bids. <br />Bids will be opened July 29 and award made at the August 1 3 meeting. <br />Preliminary estimates indicate demolition cost of $26,000. <br /> <br />Motion by Williams. seconded by Benke. to APPROVE THE <br />SPECIFICATIONS FOR BUILDING REMOVAL IN TIF DISTRICT NO. 15 AND <br />AUTHORIZE ADVERTISEMENT FOR BIDS. <br /> <br />5 Ayes - 0 Nayes, Motion Carried. <br /> <br />Council Business <br /> <br />Flood Ordinance <br />Amendment <br />Shorten Summary <br />Report 91-145 (D) <br />Resolution 91-67 <br /> <br />Building Removal <br />TIF 15 <br />Report 91-146 <br /> <br />Bob lindaU, Holmes and Graven, explained that he is representing the City Oak Grove landfill <br />in the negotiations relating to the cleanup of the Oak Grove landfill. <br /> <br />The Oak Grove Landfill was operational 1967 to 1983. Joseph Egan <br />owned and operated the landfill from 1967 to 1976, but in 1976 the <br />Pollution Control Agency (PCA) seized Egan's operating permit because of <br />disposal problems. Egan retained ownership of the land and leased the <br />landfill to a consortium of 6 garbage haulers, Northwest Disposal, Inc. <br /> <br />In 1984, the Environmental Protection Agency (EPA) filed a lien against <br />the property. EPA and PCA conducted a $1.5 million investigation and <br />determined the landfill should be capped off to properly terminate the <br />operation. <br />
