RESOLUTION NO. 06~094 STATE OF MINNESOTA COUNTY OF RAMSEY CITY OF NEW BRIGHTON RESOLUTION making findings of fact and approval of an application for Contamination Grant Cleanup funds for a portion of the Northwest Quadrant. WHEREAS the City of New Brighton (hereinafter, ''the City") has committed to the redevelopment of the Northwest Quadrant area through property acquisitions, developer designation, and teclmical and financial planning, and WHEREAS the City has incurred and expects to continue to incur costs for environmental assessment and remediation, and WHEREAS the State of Minnesota offers a grant program to assist local units of government in the paying for such costs, BE IT RESOLVED that the City hereby approves the Contamination Cleanup grant application to be submitted to the Department of Employment and Economic Development (DEED) on November 1, 2006 (hereinafter, "the application"), by the City, for the "Northwest Quadrant - West of Old Highway 8" site. BE IT FURTHER RESOLVED that the City agrees to act at the legal sponsor for the project contained in the application to be submitted on November 1,2006 and that the City Manager is hereby authorized to apply to DEED for funding of this project on behalf of the City. BE IT FURTHER RESOLVED that the City has the legal authority to apply for financial assistance, and the institutional, managerial, and financial capability to ensure adequate project administration. BE IT FURTHER RESOLVED that the sources and amounts of the local match identified in the application are committed to the project identified. BE IT FURTHER RESOLVED that the City has not violated any Federal, State or local laws pertaining to fraud, bribery, graft, kickbacks, collusion, conflict of interest or other unlawful or corrupt practice. BE IT FURTHER RESOL VED that upon approval of its application by the state, the City may enter into an agreement with the State of Minnesota for the above- referenced project, and the City certifies that it will comply with all applicable laws and regulation as stated in all contract agreements. BE IT FURTHER RESOLVED that the Acting City Manager is hereby authorized to execute such agreements as are necessary to implement the project on behalf of the applicant.
