<br />RESOLUTION NO. <br />06~094 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION making findings of fact and approval of an application for <br />Contamination Grant Cleanup funds for a portion of the Northwest Quadrant. <br /> <br />WHEREAS the City of New Brighton (hereinafter, ''the City") has committed to the <br />redevelopment of the Northwest Quadrant area through property acquisitions, <br />developer designation, and teclmical and financial planning, and <br /> <br />WHEREAS the City has incurred and expects to continue to incur costs for <br />environmental assessment and remediation, and <br /> <br />WHEREAS the State of Minnesota offers a grant program to assist local units of <br />government in the paying for such costs, <br /> <br />BE IT RESOLVED that the City hereby approves the Contamination Cleanup grant <br />application to be submitted to the Department of Employment and Economic <br />Development (DEED) on November 1, 2006 (hereinafter, "the application"), by the <br />City, for the "Northwest Quadrant - West of Old Highway 8" site. <br /> <br />BE IT FURTHER RESOLVED that the City agrees to act at the legal sponsor for the <br />project contained in the application to be submitted on November 1,2006 and that the <br />City Manager is hereby authorized to apply to DEED for funding of this project on <br />behalf of the City. <br /> <br />BE IT FURTHER RESOLVED that the City has the legal authority to apply for <br />financial assistance, and the institutional, managerial, and financial capability to <br />ensure adequate project administration. <br /> <br />BE IT FURTHER RESOLVED that the sources and amounts of the local match <br />identified in the application are committed to the project identified. <br /> <br />BE IT FURTHER RESOLVED that the City has not violated any Federal, State or <br />local laws pertaining to fraud, bribery, graft, kickbacks, collusion, conflict of interest <br />or other unlawful or corrupt practice. <br /> <br />BE IT FURTHER RESOL VED that upon approval of its application by the state, the <br />City may enter into an agreement with the State of Minnesota for the above- <br />referenced project, and the City certifies that it will comply with all applicable laws <br />and regulation as stated in all contract agreements. <br /> <br />BE IT FURTHER RESOLVED that the Acting City Manager is hereby authorized to <br />execute such agreements as are necessary to implement the project on behalf of the <br />applicant. <br />
