<br />RESOLUTION No <br />06-099 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT <br />AND ApPROVING NC06~02 and VN06-02 <br /> <br /> <br />EREAS, an application has been made by Douglas Isiminger to be considered <br />a Type 4 Non-Conforming Use Permit to allow the side yard encroachment <br />Variance to allow the front yard encroachment of the single family house at <br />15 14th Ave NW; and <br /> <br />HEREAS, the procedural history of the application is as follows: <br /> <br />1. An application for a type 4 non-conforming use permits was filed <br />with the City of New Brighton on August 31, 2006. <br />2. An application for a variance was filed with the City of New <br />Brighton on August 31, 2006. <br />3. On September 19,2006, the Planning Commission held a public <br />hearing and all present were given an opportunity to be heard; and <br /> <br />HEREAS, the City Council makes the following Findings of Fact in respect to <br />06-02 : <br /> <br />1. The subject site is zoned R-I, Single-Family Residential. <br />2. The proposed use is allowed in the R-I zoning district. <br />3. The future use for the site is low density residential; and the <br />proposed use is consistent with New Brighton Comprehensive Plan. <br />4. The applicant is requesting a Type 4 Non-Conforming Use Permit to <br />construct an addition to the house. <br />5. A Type 4 Non-Conforming Use Permit is required for the City to <br />review the site plan. <br />6. Where Type 4 nonconformities are present and are proposed to <br />continue, expansion of the existing structure, construction of new <br />structures, or resumption of use after discontinuance of use for six or <br />more months shall be allowed only upon permission of the City <br />Council <br />7. As specified in Section 8-460 (2) of the New Brighton Zoning <br />Ordinance, no Type 4 Nonconforming Use Permit shall be granted <br />unless one or more of the following conditions are met: <br /> <br />a. The total number of nonconformities is reduced. <br />b. The impact of any nonconformity upon adjacent premises is <br />reduced to the greatest practical extent. <br />
