<br />RESOLUTION No <br />06.100 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />SOLUTION MAKING FINDINGS OF FACT AND ApPROVAL OF A SITE PLAN REVIEW <br />AND VARIANCE. <br /> <br /> <br />HEREAS, an application has been made by Randy Grachek to be considered for a <br />Site Plan review and parking setback Variances by the Planning Commission. <br /> <br />HEREAS, the procedural history of the application is as follows: <br /> <br />1. An application for a Site Plan review was received on April 20, 2006. <br /> <br />2. An application for a parking lot Variance was received on August 30,2006 <br /> <br />3. The Planning Commission, pursuant to published and mailed notices, held a <br />public hearing on September 19, 2006 and all present were given a chance <br />to freely speak at the hearing. <br /> <br />HEREAS, the Planning Commission makes the following Findings of Fact in respect <br />to LP2006-002 and VN2006-005: <br /> <br />1. The property is currently occupied by Hank's Specialities. <br />2. The property is zoned I-I, Light Industrial. <br />3. The property is approximately 6.1 acres in area. <br />4. The Planning Commission recommended approval for a Site Plan review <br />in accordance with Section 8-010. <br />5. The applicant applied for a front yard parking setback variance to allow <br />the surface parking area to be located 19' from the front lot line where 40' <br />is required. <br />6. Where there are practical difficulties or unusual hardships in the way of <br />carrying out the strict letter of the provisions of the City of New Brighton <br />Zoning Code, the Council shall have the power, in a specific case, to <br />permit variances from the provisions of this ordinance. The crucial points <br />of the variance are: <br />a. Undue hardship <br />b. Uniquire circumstances <br />c. Conformance with the Comprehensive Plan <br />d. Variance shall not be detrimental to adjacent property or to the <br />public has a whole. <br />7. The Planning Commission finds that all variance criteria are met. <br />
