'. <br /> <br />'" <br /> <br />RESOLUTION NO. 85-73 <br /> <br />RESOLUTION ORDERING SECURING <br />OF STRUCTURE LOCATED AT <br />784 FOURTH AVENUE N.W. <br /> <br />BE IT RESOLVED by the City Council of the City of New <br />Brighton as follows: <br /> <br />FINDINGS <br /> <br />1. The structure is located upon land at 784 Fourth Avenue N.W. <br />in the City of New Brighton, the legal description of which <br />is shown on Exhibit A, attached hereto and hereby made a <br />part hereof. <br /> <br />2. The structure is in a state of disrepair which makes it <br />unfi t for occupancy, a rodent harborage and a nuisance to <br />neighbors in the area. <br /> <br />3. The structure is unoccupied and susceptible to trespass. <br /> <br />4. The structure is in such an advanced stage of damage and <br />disrepair that persons corning into the structure are sub- <br />jected to hazardous conditions including the substantial <br />risk of injury due to falls, defective electrical wiring and <br />light fixtures, and the accumulation of garbage throughout <br />the house. <br /> <br />5. The structure would be made sufficiently safe adequately to <br />protect the public health and safety on a temporary basis if <br />it were secured and boarded up. <br /> <br />CONCLUSIONS <br /> <br />1. Based upon the foregoing, the City Council concludes that <br />the structure located at 784 Fourth Avenue N.W. constitutes <br />a hazardous building within the meaning of Minnesota Stat- <br />utes 1982, Section 463.15 and as such is a fire hazard and <br />health and safety hazard to the public. <br /> <br />2. That such structure could be made more safe by securing and <br />boarding up the same. <br />
