That an application for a nonconforming use permit was filed with the I <br />the City on July 1. 1985. I <br />2. That the Planning Commission, pursuant to published and mailed notice~1 <br />held a public hearing on July 16. 1985. all person's present at the i <br />hearing were given an opportunity to be heard. , I <br />3. That the application for a nonconforming use permit NC-73 was reviewed! <br />by the City Council on July 23. 1985 and that the comments and I <br />analysis of staff and the Planning Commission minutes and recommenda- <br />tions were considered. <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING NC-73 FOR AMERICAN LEGION <br />POST 513 <br /> <br />WHEREAS. an application for a nonconforming use permit has been made <br />by American Legion Post 513; and <br /> <br />NOW THEREFORE BE IT RESOLVED by the City Council that the following <br />Findings of Fact are made in respect to NC-73: <br /> <br />1. That the site is zoned B-3. General Business. <br />2. That the site was vacant for in excess of 6 months. <br />3. That the site has the fo 11 owi ng Type I V nonconformi ties: <br />a. Less than required 30 foot rear yard building setback. <br />b. Less than required 30 foot rear yard buffer area and less than <br />required 20 foot side street yard buffer area. <br />c. More than permitted two curb cuts. <br />d. Curb cut in excess of 36 feet in width. <br />e. Lack of concrete curbing. <br />f. Lack of required front yard landscaping in northeast corner of <br />the site. <br />g. Less than required distance of 50 feet from curb cut on 4th Street <br />to street intersection. <br />4. That the applicant will reduce the total number of existing Type IV <br />nonconformities on the site and reduce the impact of the nonconfor- <br />mities on adjacent properties by doing the following: <br />a. Reducing the number of curb cuts to two. <br />b. Move the curb cut on 4th St. 67 feetcfromthe street intersection. <br />c. Reduce the width of the curb cut on Old Highway 8 to 32 feet. <br />d. Provide 30 feet of landscaping in the northeast corner of the site <br />to be tied in with the front yard landscaping of J & B Auto. <br />e. Install concrete curbing along all parking and drive areas. <br />f. Provide 3 foot berms with the planting of black hills spruce trees <br />along 4th Street NW and 9th Avenue NW. <br />5. That improvements are proposed for the building in the form of wood <br />trim on the canopy and painting the building. <br /> <br />BE IT FURTHER RESOLVED that the application NC-73 is and hereby approved <br />subject to the following conditions: <br /> <br />1. That boulevard trees be planted along Old Highway #8. <br />2. That a current certificate of survey be submitted. <br />3.
