<br />~; <br /> <br />i? <br /> <br />., <br /> <br />RESOLUTION NO.85-64 <br />S TAT E 0 F M INN [S 0 T A <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING NC-71 <br /> <br />WHEREAS, an application for a nonconforming use permit has <br />!: bee n m a de by J 0 h n Lan g e; and <br /> <br />WHEREAS, the procedural history of the application is as <br />follows: <br /> <br />1. That the application for a nonconforming use permit <br />was filed with the City on May 22, 1985. <br />2. That the Planning Commission, pursuant to published and <br />mailed notices, held a public hearing on June 18, 1985, <br />all person's present at the hearing were given an <br />opportunity to be heard. <br />3. That the application for a nonconforming use permit, <br />NC-71, was revi ewed by the Ci ty Counci 1 on June 25, <br />1985, and that the comments and analysis of staff and <br />the Planning Commission minutes and recommendations <br />were considered. <br /> <br />NOW THEREFORE BE IT RESOLVED by the City Council that the <br />following Findings of Fact are made in respect to NC-71: <br /> <br />1. That the nnly remaining Type IV site nonconformity <br />is the less than required 15 foot side yard setback of <br />the original building. <br />2 That the applicant addressed all the site Type IV non~ <br />conformities to the extent practical under NC-28. <br />3. That the proposed new building complies with the current <br />1-1, Light Industrial code requirements. <br /> <br />BE IT FURTHER RESOLVED that the application NC-71 is and <br />hereby approved subject to approval of LP-182. <br /> <br />Adopted this 25th day of June, 1985. <br /> <br />~t3 ~.--", <br /> <br />Greg. y .
