<br />" <br /> <br />I <br />II <br />,\ <br /> <br />'. <br /> <br />Ij <br /> <br />RESOLUTION NO. 85-55 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING APPROVAL OF <br />NC-68 <br /> <br />WHEREAS, an application for a nonconforming use permit has <br />been made by Crown CoCo, Inc. - E-Z Stop; and <br /> <br />WHEREAS, the procedural history of the application is as <br />follows: <br /> <br />1. That an application for a nonconforming use permit was <br />filed with the City on May 6, 1985, <br />2. That the Planning Commission, pursuant to published and <br />mailed notices, held a public hearing on May 21, 1985, <br />all person's present at the hearing were given an <br />opportunity to be heard. <br />3. That the application for a nonconforming use permit, NC- <br />68 was reviewed by the City Council on May 28, 1985 and <br />that the comments and analysis of staff and the Planning <br />Commission minutes and recommendations were considered. <br /> <br />NOW THEREFORE BE IT RESOLVED by the Planning Commission that <br />the following Findings of Fact are made in respect to NC-68: <br /> <br />1. That the existing site Type IV nonconformities include <br />the following: <br />a, More than permitted two curb cuts. <br />b. Curb cuts less than 50 feet from a street intersection. <br />c. Lack of concrete curbing. <br />d. Lack of landscaped buffer area between the site and <br />adjacent R-l zoned properties. <br />e. Lack of designated on-site parking. <br />f. Less than required 30 foot rear yard building setback. <br />g. Less than required front yard parking setback. <br />h. Lack of front yard landscaping. <br />2. That the applicant has proposed to address the existing <br />" Type IV nonconformities by doing the following: <br />a. Eliminating the western most curb cut on 6th Street. <br />b. Removing the phone booth from the boulevard. <br />c. Installing concrete curbing around all parking and <br />drive areas. <br />d. Providing a 6 foot cedar fence with landscaping along the <br />west property line and a 9 foot landscaped buffer area <br />along the north property line. <br />e. Providing designated on-site employee and partron <br />parking, with one handicapped stall. <br />f. Increasing the front yard parking and drive setback an <br />providing landscaping in the front yard setback. <br />g. Combining the present price sign on the same pole as <br />the main logo sign. <br />h. Working with the adjacent single family home owners on <br />construction of a fence in the rear yard of the site <br />to prevent access to E-Z stop from the alley. <br />3. That the existing Type IV nonconformities have been of thJ <br />reduced to the extent practical and that the impact ~ <br />Type IV nonconformities on adjacent properties hav.e been <br />reduced to the extent possible. <br /> <br />BE IT FURTHER RESOLVED that the application NC-68 is and <br />hereby approved subject to the following conditions: <br /> <br /> <br />_l~_Approval of LP-178. <br />_---2.~Coriformance with site and building plans as signed and <br />~~ted by the applicant and City Planner. <br /> <br />Aq-opteci 1:h-is 28th day of May, 1985 .~. <br /> <br />, ~fl~ <br />/~- <br /> <br />Henry S. da, City Manager <br /> <br /> <br />A.
