<br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />SITE HISTORY A:'I"D PAST LEGISLATIVE ACTION (CONT.) <br /> <br />Belair Builders acquired the property and subsequently requested several land use approvals <br />from the City. The follov.ing is a summary of the City's past action for this site. <br /> <br />. July 23, 1991 the City Council considered a site plan review (LP-259), special use permit <br />(SP-164) and a front yard setback variance (VN-285) to construct an office/storage <br />facility and associated outdoor storage yard on a portion of the site. The company <br />proposed to build an 11,000 square foot office/shop to house their headquarters, along <br />with outdoor storage of black dirt, bituminous, concrete and gravel. The City Council <br />tabled action on the applications, pending resolution of questions concerning subdivision <br />of the parcel and impacts on environmental clean-up. <br /> <br />. October 8, 1991 the City Council approved the site plan (LP-259), special use permit <br />(SP-164) and a subdivision (PL-191) of the parcel, subject to several conditions. The <br />subdivision of the parcel eliminated the need for a variance. The special use permit <br />allowed the outdoor storage of stockpiled materials. The company indicated that it would <br />pursue a separate remediation plan for the balance of the site that contained the landfill. <br />The approvals included several conditions, which appear to have been met. <br /> <br />. October 24, 1995 the City Council approved a special use permit (SP-188), which <br />authorized the excavation of 88,000 yards of soil from an adjoining site. It appears that <br />this activity was not directly tied to Belair's operations, but it did allow the mining of <br />sand for a separate project. The approval was subject to several conditions. <br /> <br />. November 28, 1995 the City Council approved a special use permit (SP-189) to cap the <br />l4-acre landfill. Belair was unable to initiate the capping work or the excavation under <br />SP-188 and made a subsequent request on August 13, 1996 to extend the City's approvals <br />for one additional year. The City Council approved the extensions and it appears that the <br />company complied with the conditions of both special use permits. <br /> <br />STAFF ANALYSIS <br /> <br />Comprehensive Plan Amendment <br /> <br />The applicants have also requested a Comprehensive Plan Amendment as the property is <br />currently guided in the New Brighton Comprehensive Plan for Light Industrial and the proposed <br />use is considered Heavy Industrial. These land use designations can be found in Figure 5-2 of <br />the New Brighton Comprehensive Plan. <br /> <br />The Comprehensive Plan indicates that many of the industrial uses along the Old Highway 8 <br />corridor are interim-type uses due to the level of contamination that exists on many of these <br />properties. As noted within the applicants' submittal materials the property in question contains <br />contamination and thus "there is no economical means" of developing the site in accordance with <br />I-I zoning requirements. The intention of the Plan and the Light Industrial land use designation <br />is to provide a direction or long-term plan for all property in the City. The intention of the <br />Comprehensive Plan is not whether the use can at any given time period be economically <br />developed into the desired use. <br />
