Purpose: <br /> <br />The facility located at 2200 Old Hwy 8 NW, New Brighton, MN 55112 is currently <br />owned and operated by the Murlowskis of Belair Excavating, It is currently being used as <br />an outdoor aggregate recycle operation along with a heavy equipment and aggregate <br />material storage yard. This site is a reclaimed demolition landfill. Starting in the early <br />1960' s the property was used by a number of demolition contractors for disposal of <br />debris from various demolition projects. There is evidence of debris filled to a depth of <br />thirty-five feet or more on the majority of the parcel. In October of 1990 testing <br />commenced to determine an appropriate remediation procedure, Starting in 1991 Belair <br />Excavating began an MPCA approved reclamation process on the property, This process <br />required the placement of a minimum of two feet of impervious clay material to cap the <br />land filled area, Currently the adjacent property to the south up to the railroad tracks has <br />not been remediated, This parcel is currently owned by the United States Government. <br />We are including this additional area in the Rezoning Application and the Comprehensive <br />Plan Amendment Application, <br /> <br />I <br />i <br />I <br /> <br />Because of the existing conditions on these properties there is no economical means of <br />building sizeable structures or using it for anything other than surface type operations that <br />are restricted under the current I-I zoning, The cost of placing pilings to make that land <br />buildable simply would be cost prohibitive, A much more productive parcel can be <br />utilized with an 1-2 zoning designation which in turn requires an Amendment to the <br />current Comprehensive Plan, Currently the site is underutilized due to the restrictive I-I <br />zonmg, <br /> <br />The operation will cause no negative impacts to adjacent properties because of the unique <br />location that is far removed from any residential use, The neighboring properties are all <br />zoned and guided for industrial uses, The property is adjacent to an active railroad line, <br />that dramatically limits the likelihood of any further residential use in the area. <br /> <br />The Murlowski's are requesting a Rezoning from I-I to 1-2 and an Amendment to the <br />current Comprehensive Plan to allow for the 1-2 District. The rezoning allows for a more <br />productive use for the property as discussed above and directly benefits the City of New <br />Brighton by reducing the costs of its City road projects, The proposed new zoning <br />district will more accurately reflect the current heavy industrial use of the property. The <br />Comp Plan Amendment is being sought to maintain consistency between the plan and the <br />zoning ordinance, <br /> <br />Midwest Asphalt Corporation is applying for a Special Use Permit for outdoor storage, <br />Midwest Asphalt Corporation is planning to use state of the art equipment so that it can <br />continue to use the property for recycling used asphalt and concrete rubble, unloading <br />aggregate materials from railroad cars for its own use and distribution to local customers, <br />producing both high quality Hot Mix Asphalt (HMA) products and concrete redi-mix <br />materials, The materials transported into this site will be used to produce and/or be <br />recycled into products that will be used in unpaved and paved roads, transportation <br /> <br />3 <br />
