Femelius replied that it has been discussed and they are agreeable to that <br />stipulation. He added that the applicant would be formally notified in writing. <br /> <br />6 Ayes, 0 Nays. <br /> <br />Public Hearings: Re-Zoning, Comp Plan Amendment, Special Use Permit and Site <br />Plan Review by Belair Excavating and Midwest Asphalt to allow a Hot Mix Asphalt, <br />Concrete and Recycling Operations at 2200 Old Highway 8 NW. <br /> <br />Femelius reported that this is an incomplete application and staff does not have a formal <br />presentation at this time. Baker inquired if the applicant wished to make a comment. <br />The applicant replied that they are willing to wait until the application is presented <br />formally to the Commission. <br /> <br />Zisla inquired what the proposal is for this application and the location that is being <br />contemplated. Femelius replied that the location would be at Belair Excavating, which is <br />found at address is 2200 Old Hwy 8 NW. Belair Excavating owns roughly twenty acres; <br />part of the site is a former landfill that has been capped by the company. Midwest <br />Asphalt approached Belair about approaching the City with an application for an asphalt <br />and cement plant to continue part of their recycling business, essentially a similar <br />operation as what they currently have. Midwest Asphalt would be a tenant on the Belair <br />property. The application includes a site plan review, a rezoning of the property, an <br />amendment to the Comprehensive Plan, and a special use permit. Zisla inquired if this is <br />a relocation of the current operation. The applicant replied that is a relocation of the <br />current operation. <br /> <br />Zisla asked if the City owns the property that Midwest Asphalt operates. Fernelius <br />replied that the City has a settlement agreement with Midwest Asphalt and in December <br />the City will close on the balance of the property. Zisla inquired if Midwest Asphalt is <br />being paid relocation benefits as part of the settlement. Femelius replied that as part of <br />the settlement the business and landowner were paid a fix amount. O'Brien asked if <br />moving to the new site a condition of the settlement. Femelius replied it is not a <br />condition of the settlement. <br /> <br />Schiferl asked if the property abuts the Mounds View boarder and Rush Lake. Fernelius <br />replied that is correct, Mounds View is to the north of this property; however it borders <br />Long Lake Regional Park to the west. Schiferl inquired if the analysis will include the <br />comprehensive plan for Mounds View.
