<br />-2- <br /> <br />for deleting the curbing in these areas is to allow sheet drainage <br />storm water through the grass area which provides some filtering of <br />pollutants in the storm water. The curbing is also proposed to <br />be deleted from the south side of the parking lot as this would <br />be the area where the parking lot would be expanded in the future <br />and these concrete curbs would then have to be torn out. The applicant <br />proposes instead I believe to put concrete bumper curbs along this <br />side of the parking lot. The only question with regard to code <br />requirements ~s it affects the concrete curbing relates to that <br />area along the south end of the parking lot which is closer to <br />the front lot line than the buildin~ Under the definition of a front <br />yard in Section 2-720, the front yard extends from the front lot <br />line to the principal structure and from one side lot line ~~, the <br />other. A literal reading of that definition would put the 'area in <br />question in the front yard and require that the curbing in left in <br />that location. Under the definition of yard, however, in Section <br />2-710 the Council is given the authority to determine the yards at <br />the time of building permit issuance where because of the unusual <br />configuration of a principal structure or of a lot, the definition <br />of any yard appears inapplicable. This section, of course, was <br />added after the building permit for the building in question was <br />issued. In this case, the area of the lot that is under discussion <br />is not immediately adjacent to a street but rather adjacent to <br />another industrial development and it would seem to be within the <br />Council's power to determine that concrete curbing in this location <br />would not be necessary to meet the requirements of the Code because <br />of~the unusual configuration of the yard in relation to the streets <br />in the area. <br /> <br />The applicant would like, therefore, the Council to approve <br />a revision to the landscape and plot plan to allow the modification <br />of the landscaping according to a revised plan that has been <br />submitted and to allow modification of the parking areas and concrete <br />curbing according to a revised site plan that has been submitted. <br /> <br />The second request of the applicant which is under discussion <br />at this time is a request to be allowed to occupy the building <br />without a sprinkling system having been installed. According to the <br />requirements of the Uniform Building Code, the fire sprinkler system <br />is required, however, the union whose members install sprinkler systems <br />has been on strike for quite some time and from all indications, <br />will be on strike for quite some time to come, in addition to which <br />even once the strike is settled, the considerable back log of work that <br />exists because of this strike will take a long time to be removed. <br />
