<br />I !" -..- <br /> <br />- I:. <br /> <br />RESOLUTION NO <br /> <br />85-38 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION APPROVING SUBDIVISION OF CERTAIN PROPERTY WITHIN THE <br />CITY OF NEW BRIGHTON (generally north of Mounds Avenue East of <br />Old Highway 8) <br /> <br />WHEREAS, the City of New Brighton has been requested to sub- <br />divide certain property in the City of New Brighton described <br />as follows: <br /> <br />PARCEL 1 <br /> <br />The East 150 feet of the South 187.5 feet of the North 427.5 <br />feet of part of the Northwest a of the Southwest! South of <br />the 100 foot Railway right-of-way and West of a line 315 <br />feet East from and parallel with the East line of State <br />Trunk Highway 8 and 63, in Section 16, Township 30, Range 23, <br />except that part as acquired by State of Minnesota for high- <br />way purposes in final certificate recorded as Document <br />#1708007 and including the South, of vacated View Avenue <br />lying Westerly of the Westerly right-Of-way line as described <br />in said Document. <br /> <br />PARCEL 2 <br /> <br />That part of the Northwest i of the Southwest! of Section <br />16, Township 30, Range 23, described as follows: Beginning <br />at a point on the West line of said Section 16, distant 240 <br />feet South of the 100 foot wide railroad right-of-way <br />described in "108611 Deeds 611 in the office of the Register <br />of Deeds in and for said County; thence East parallel with <br />said right-of-way to a point distant 165 feet East of the <br />East right-of-way of State Trunk Highway No 8 as hereinafter <br />described; thence South parallel with said highway right-of- <br />way line 75 feet; thence West parallel with said railroad <br />right-of-way to said West line of said Section; thence North <br />on West section line 75 feet to the point of beginning; <br />subject to pUblic highways and easements, said East right-of <br />way line of said Highway No.8; being a straight line from a <br />point on the South line of said section distant 75 feet East <br />of the Southwest corner thereof to a point on the North line <br />of the Southwest a of Section 16 distant 79.25 feet East of <br />the Northwest corner of said Southwest 1 and including the <br />South ~ of vacated View Avenue lying Westerly of the Westerly <br />right-nf-way line as described in said Document. <br /> <br />PARCEL 3 <br />Lots 14 and 15, Block 4, Mounds Center, Ramsey County, MN. <br />Subject to highway. <br /> <br />WHEREAS, State Statutes require that if such property is <br />located in municipalities that have adopted a platting ordinance, <br />approval of that municipality must be obtained before such sub- <br />divisions can be filed; and <br /> <br />WHEREAS, Section 26-24 of the New Brighton City Code <br />provides for subdivision of property without platting if certain <br />i cri teri a has been met; <br /> <br />WHEREAS, the City Council has determined that such criteria <br />has been met. <br /> <br />NOW THEREFORE BE IT RESOLVED by the Council of the City of <br />New Brighton that the Council approves subdivision of the above <br />described property into parcels described as follows: <br />
