..

MEMORANDUM

r

....

DATE February 11, 1980

TO Dennis S. Zylla, City Manager
FROM James F. ~inkels, Director of Community Development

SUBJECT: STOCKMAN'S STEAK HOUSE
Mississippi Street & 26th Avenue N.W.

The original authorization for a building permit for the Stockman's
Steak House (J,Welsch) at the above noted location contained a
provision for additional landscaped berms along 26th Avenue N.W.
and 22A Street,

In addition the attached letter form the former Director of
Community Development notes that the building must be shifted
somewhat to the east so that'the required buffer strip can be obtain-
ed along 29th Avenue N.W.

Along with the original site, landscape and building plans the
ipplicant has inserted a revised sketch showing the building re-
located so as to provide for the required buffer strip. The plans
do not however, indicate berms along 26th Avenue N.W, and 22A Street,
landscaping of these areas is however shown~

Any approval of the building permit should therefore include a
condition that these berms be provided.

Other than the above, the plans indicate, complete conformance with
requirements of the existing B-3 zoning classification, as was the
case several years ago when the plans were originally submitted .
to City Staff. We feel it'is important to raise a point first
noted over four years ago, That is, that the parking shown on the
site is adequate for the number of seats proposed (189), which
seating is confined to the first floor, There is a basement area
to the building which as shown on the plan will have access via
two stairways and an elevator. The applicant has always indicated
that this area 'would be used primarily for.storage. This area may
not be used for additional .seating as it will create a non-
conformity in terms of parking, and could possibly create a viola-
tion in regard to the liquor license fee under the ordinance.
, '

If the building permit is legally to be authorized with the site
amendment noted above we would recommend the following:

1, That a revised landscape plan be received showing
berms along 26th Avenue N.~l. and 22A Street.
2, That all grading and drainage be subject to
approval of the City Engineer.
3. That approval be subject to revised plans dated
and signed by the applicant and City Planner.
