The permit was <br />conditioned on compliance with the applicant's site and landscape <br />plans. A copy of the Council minutes regarding this matter is <br />attached. <br /> <br />Prior to the building being occupied, a certificate of occupancy <br />must be obtained. If the building is to be occupied prior to all <br />site and landscape work being completed, a temporary certificate <br />of occupancy can be obtained. To obtain the temporary certificate <br />the City of New Brighton requires assurance that the remaining <br />work will be completed. Specifically, City ordinances require <br />that a cash deposit, surety bond or other similar type performance <br />bond, acceptable to our City Att0rney, be posted in an amount equal <br />to the valuation of the remaining site and landscape work. In this <br />particular case, the remaining work primarily involves landscape <br />work and asphalt paving of driving and parking areas. Ordinance <br />requirements for certificates of occupancy are also attached. <br /> <br />Once the appropriate guarantee has been provided, the temporary <br />certificate of occupancy can be issued. This temporary certificate <br />is valid for nine (9) months. If at any time during the nine months <br />the work is completed, the bond can and will be released. <br />
