. COUNCIL CONSIDERATION
BUILDING PERMIT
July 27, 1976

page 2

LP-34

The plot plan also indicates that there is another sewer ease-
ment approximately 185 feet east of the front lot line. We
have checked our records and have not found a sewer line to be
located in this area. It is City Engineer's feeling that the
easement may have been at one time for a drainage ditch. The
City Engineer further indicated that there are no future plans
including the use of this easement. While building over this
easement would seemingly cause no problems for the City of New
Brighton, the applicant may want to petititon to have the ease-
ment vacated. Vacating the easement would eliminate any
potential easement problem and may also help the applicant in
securing financing.

The City Engineer has reviewed the plot plan and has indicated
that the drainage would be handled sufficiently as shown.

The landscape plan indicates that the front yard would be
landscaped with sod and other plantings. The landscape plan
is complete and contains the required- information

The plot plan is complete with the exception that some dimensions
for parking spaces and driving lanes have not been shown. This
may be a minor concern as ~here would appear to be ample room on
the property if additional space is needed.

All applicable zoning code requirements in regard to this proposal
have been met with the exception that small areas of the 8th
Avenue exterior treatment are shown to be contrasting painted
concrete block. According to Section 10-130, the exterior
treatment on the street of the structure cannot be painted
concrete block. The Boa~d of Review may want to consider a
condition of approval that these areas be other than concrete
block.

PLANNING COMMISSION CONSIDERATION AND RECOr.WffiNDATION (7/20/6):

The city Planner. reviewed his comments noting that the applicant
may want to petition to vacate a sewer easement over which the
building is proposed to be built. The City Planner. further sug-
gested that it may be advisable to position the building slightly
fur~her east to avoid any potential problem with the sewer line
easement directly in front of the building.

John Murlowski, representing the applicant was pres8nt to answer
questions. Mr. Murlowski indicated that there would not be a
problem in moving the building further east. Mr. Murlowski also
indicated tha't they had intended to petition to vacate the sewer
easement over which the building is to be built.
