f!!.,~..~

BELAIR

CONTRACTORS
443. 8th Avenue N, W., New Brighton, MN. 55112

July 21, 1976

City Council of New Brighton
New Brighton, Minnesota 55112

Dear Council l'Iembers:

Let this letter serve as ~ITitten request to vacate sewer
easement of 11/23/60 as per attachment for the reasons out-
lined below.

Belair Builders, Inc. is proposing to build a diesel engine
repair shop for o~mers, Mr. & Mrs. Robert Drayna. The plans
and all other requirements have been inspected and approved
by the New Brighton Planning Commission as of 7/20/76. The
proposed building would be constructed over the aforementioned
sewer easement.

In checking with the New Brighton Public Works Department,
it has been discovered that the aforementioned sewer easement
has not and will never be used, since the existing sanitary
sewer line which runs across the fron~ of the proposed
structure is adequate for present and future use.

In spite of the fact that the easement will undoubtedly never
be used, you can well imagine the potential problems involved
if it was decided, for example, in 1990 that the easement is
needed. For this reason, I would greatly appreciate your
approval of my request to vacate this easement.

I would further appreciate anything you can do in order to
approve this request at your earliest possible convenience.
Construction was due to commence on 8/1/76. I would rather
not start construction until the easement has been vacated.

If I can be of assistance in any way in your efforts to
expedite this matter, please feel free to contact me any time.
I would be more than happy to answer any questions.

Thank you kindly for your consideration in this matter.
~

..

JHIvl : mmr
