Kleinschmidt, Director of Public Works <br /> <br />RE: Proposed Vacation of Sewer Easement through <br />Bel-Air Property <br /> <br />The County Section Maps show two sewer easements, approximately <br />parallel, through the above-described property. This property is <br />presently occupied by Midwest Asphalt and it is immediately south <br />of the Dairy Queen on the east side of Old Highway 8. <br /> <br />Attached is a print of the section map in this area showing the <br />two sewer easements colored in red and showing the existing <br />sanitary sewer in green. You will note that the existing sanitary <br />sewer follows the westerly easement through this property. We <br />double checked this in the field and found this to be true. Also <br />we found that no municipal utilities exist in the easterly ease- <br />ment. through this property. <br /> <br />Since the Bel-Air Corporation furnished us with an easement <br />description that describes the easterly easement, and since this <br />easement description starts opposite 6th Street, NW, and ends <br />opposite 3rd Street, NW, it is not recommended that this entire <br />easement be vacated. Our sanitary sewer presently exists on part <br />of this easement. I would recommend that the easterly easement <br />be vacated but only through the Bel-Air property. <br /> <br />The description of the easterly easement through the Bel-Air <br />property that is proposed to be vacated is described below: <br /> <br />"THAT PART OF THE FOLLOWING DESCRIBED EASEMENT: <br /> <br />A strip of land 10 feet wide/the West line of which is <br />described as follows: Beginning at a point on the east line <br />of the West 250 feet of the NE ~ of Section 29, 180 feet north <br />of the South line thereof; thence southwesterly to a point in <br />the East line of the West 150 feet of the SE ~ of Section 29, <br />1,250 feet north of the South line thereof and there terminating; <br />
