The city Engineer <br />has indicated this should be satisfactory. <br /> <br />A concern for this cellar is the effect the increased building <br />area has on the number of parking spaces provided. We have <br />recalculated the parking situation, figuring the cellar on a <br />retail sales basis, and it appears the application would still <br />have a small surplus of spaces over that required by ordinance. <br />We would note, however, that the surplus of spaces is so minimal <br />so as to apparently preclude the possibility of further building <br />expansion, unlesp of course, additional land were acquired. <br /> <br />Landscape Plan: <br /> <br />The Rice Creek Watershed District requirement of baffled weirs <br />requires a change in the applicant's landscape plan. We would <br />suggest that this be received prior to final approvals. <br /> <br />Conclusion: <br /> <br />As noted in the City Manager's Newsletter, the applicant has <br />asked for this matter to be placed on Tuesday's agenda. As noted <br />above, there are several documents still needed to comply with <br />the Council conditions. The applicant has stated that all submittals <br />will be available prior to Tuesday's meeting. They must still, <br />however, be reviewed by the City Rttorney. If the Council so <br />desired, a conditional approval may be able to be given based on <br />receipt of the missing items. We would also suggest that any <br />approval or certificates of occupancy be conditioned on the <br />applicant providing verification that all easements or quit claim <br />deeds have been properly recorded. <br />
