That t~ere was filed with the City on August 13, 1976 an application, VN-159~ for a variance to allow a 45 foot wide driveway on Silver Lake Road rather than the maximum 36 foot wide driveway permitted in Section 12-060 (f) of the Zoning Code; 2. That said application was heard and reviewed by the Planning Commission at its meeting of August 17, 1976; ., 3. That the City Council, pursuant to published and mailed notices, held a public hearing on September 28, 1976, to consider the applicatlon and continued such hearing to October 12, 1976, The applicant and other persons present at the hearings were given an opportunity to be heard; 4. The written comments and analysis of the City Planner, the Planning Commission minutes and recommendations and all person's statements made at the public hearings1were considered inclqding the statements of the applicant and members of the Council. BE IT FURTHER RESOLVED,That the application for VN-159 is hereby approved for the following reasons: 1. The need and reason for said variance is that the shopping center entrance is a use which has not previously been specifically considered legislatively; 2. The variance provides no special privilege because of the consolidation ,of driveways serving the proposed shopping center and adjacent properties: 3. The variance does not act as a detriment but rather promotes the interests of the public health, safety and welfare.
