<br />) <br /> <br />~ <br /> <br />Council Consideration <br />LP-38 <br />November 23, 1976 <br /> <br />Request: LP-38, Council approv~l of building permit for proposed <br />Stockm~ns Steak Hous~ <br /> <br />Applicant: Jack Welsch <br /> <br />Location: 2550 Mississippi St. (NE quadrant of Mississippi St. <br />~nd 26th Avenue mv) <br /> <br />Zoninq: B-3 <br /> <br />Exterior Treatment: Stucco '1ith cedar f2cade <br /> <br />Discussion: <br /> <br />As noted above, the ~pplicant is requesting a building permit <br />for a proposed rest~ur~nt on the north side of Mississippi St. <br />This r~staurant is proposed to have a liquor license ~nd such <br />licens~ ~pplication is being reviewed by the Council at this time. <br />A previous request for a building permit W2S reviewed by the <br />Pl~nning Commission in January of this YE~r. The application w~s <br />withdrawn at th~t time as the liquor license was denied. <br /> <br />The pl~ns which have been presented are the same as those <br />previously reviewed by the Planning Commission and are both <br />complete arid in conform~nce with the Ne'~ Brighton Zoning Code. <br /> <br />We would note that the parking shown on the site is ~dequate <br />for the number of seats listed, which se~ting is confined to <br />the first floor. There is 2 basement are~ to the building which <br />is intended, as we understand it, to be used primarily for <br />storage. This area m~y not be used for ~dditional seating as <br />it will create a non-conformity in terms of parking and <br />2lso would place the applicant in violation of the liquor ordinance <br />because it would have incre2sed his liquor license fee. <br /> <br />At the Planning Commission meeting l2st January, area residents <br />r~ised a concern in regard to the location of the building on <br />the site and suggested that the building be placed to the west <br />on the site with the parking lot to the east in order that the <br />activity nnd light from the cars not be so close to the residential <br />area. We would note first, that the are2 immediately to the west <br />is zoned B-3, General Business, ~nd not residential; although <br />the area to the north and diagonally to the northwest is zoned <br />residenti~l. Secondly, moving the building to the west on the <br />site will raise the elevation of the building dpproximately siy <br />to eight fe~t and will make it much more obstrusive in terms of <br />its visual relationship with the residential areas.
