The application w~s
withdrawn at th~t time as the liquor license was denied.

The pl~ns which have been presented are the s~me as those
previously reviewed by the Pl~nning Commission and are both
complete and in conform:mce with thE' New Brighton Zoning Code.

We would note that the parking shown on the site is ,dequate
for the number of seats listed, which se~ting is confined to
the first floor. There is a basement are~ to the building which
is intended, as we understand it, to be used primarily for
storage. This area m~y not be used for ~dditional seating as
it will create a non-conformity in terms of parking and
also would place the applicant in violation of the liquor ordinance
because it would have incre2sed his liquor license fee.

At the Planning Commission meeting l~st January, area residents
r8ised a concern in rE'gard to the location of the building on
the site and suggested that the building be placed to the west
on the site with the parking lot to the east in order that the
activity nnd light from the cars not be so close to the residential
area. We would note first, that the are~ immediately to the west
is zoned B-3, General Business, ~nd not residential: although
the area to the north and diagonally to the northwest is zoned
residentit=ll. Secondly, moving the building to the west on thE'
site will raise the elevation of the building approximatE'ly siy
to eight feet and 'viII make it much more obstrusive in terms of
its visual relationship with the residential ~reas.
