<br />RESOLUTION No. <br />06-109 <br />CITY OF NEW BRIGHTON <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br /> <br />RESOLD ON MAKING FINDINGS OF FACT AND DENYING APPLICA nONS FOR A COMPREHENSIVE <br />PLAN ENDMENT, REZONING, SITE PLAN REVIEW AND SPECIAL USE PERMIT. <br /> <br /> <br />, an application has been made by Michael Murlowski of Murlowski Properties in <br />ion with Blair Bury of Midwest Asphalt Corporation to allow a Hot-Mix Asphalt and <br />ix Concrete Production Facility at 2200 Old Highway 8 NW, <br /> <br />, the procedural history ofthe application is as follows: <br /> <br /> <br />1. application for a Comprehensive Plan Amendment, Rezoning, Site Plan Review, and <br />pecial Use Permit were received on August 28,2006. <br /> <br />2. Public Hearing notice with regard to the submitted applications was published in the <br />eptember 6, 2006 New Brighton Bulletin. <br /> <br />3. e property owners within 350' were notified of the proposed application on September <br />,2006. <br /> <br />4. letter dated September 14, 2006 was sent to the applicant requesting further <br />ormation. <br /> <br />5. n September 18, 2006 the applicant submitted the additional information requested by <br />ity Staff. <br /> <br />6. he Planning Commission, pursuant to published and mailed notices, held a public <br />earing on October 17,2006 and all parties present were heard. <br /> <br />7. he Planning Commission recommended denial to the City Council with regard to the <br />omprehensive Plan Amendment, Rezoning, Site Plan, and Special Use Permit <br />pplications. <br /> <br />8. he City Council considered the application on October 24,2006. <br /> <br />, the City Council makes the following Findings of Fact with respect to CM2006-001, <br />-006, LP2006-007, and SP2006-013: <br /> <br />1 The property is currently zoned 1-1, Light Industrial. <br />2 The Comprehensive Plan designation for the property is Light Industrial. <br />3 The property is currently occupied and owned by Murlowski Properties, Inc. who <br />conducts outdoor storage of recycled aggregate, heavy construction equipment, and <br />other supplies related to the business known as Belair Excavating. <br />4 The property is approximately 19.5 acres in area. <br />5 The applicants have proposed rezoning the area from 1-1, Light Industrial to 1-2, Heavy <br />Industrial. <br /> <br />C:\Docu 15 and Settingslkbruno\Local Settings\Temporary Internet Files\OLK58\CM2006.00I RZ2006-006 LP2006.007 SP2006-013 <br />(Murlow Ie Prop) DENIAL RESOLUTION,doc 1 <br />
