The City Planner reviewed .'the planning report and Planning Commission recommendations. NC-18 Mengelk6ch Murial Bochnak, Manager of Mengelkoch, was present to respond to Council questions. She stated that Mengelkoch was applying for permit at this time because contractors were already on the site constructing approved new construction and it would be less costly to keep them on the site for the additional building. 8:49 to 9:04 Councilman Hardt asked what the hardship was. Ms Bochnak stated that the building to be constructed was for the purpose of containing air pollution equipment so that the rendering plant could comply with City license regulations. Councilman Werdouschegg asked whether the building could be squared off ~' in the area of the proposed new construction. Ms Bochnak stated that was feasible from a construction standpoint but access would be lost to a sewer sump. Motion by Werdouschegg, seconded by Hardt to close hearing 5 ayes- 0 nayes- carried Close Hearing Motion by and adopt fact: 1. 2. 3. 4. 5. ,...-;-- 6. Fisher, seconded by Werdouschegg to waive reading resolution making the following finding of RESOLUTION NO. 1869 The property is uniquely located between Gordon Rendering, 1-35W, 14th Street and the railroad tracks. The principal structures are situated approximately.--- 350 feet from 14th Street NE 14th Street deadends near the northeast corner of the site and does not serve parties to the east. The topography of the site is such that screening is effectively provided from 14th Street. That the items noted above create both unique circumsta~ces and undue hardships in this application. That the purpose of the structure is to house air pollution abatement equipment, therefore making it an issue of public heal th,' safety and welfare.
