All
code requirements are met through this application. A current
survey has been submitted which corresponds to the lot dimensions
shown on the site plan.

Planninq Commission Considerati-illJ.__& Reco~~!ldati_Q_n (l0/18/77)

LP-58, D.W. Const.
The City Planner reviewed his comments noting that the site plans
indicate that access to the property would be from the 33 foot
access driveway to the Rice Creek Center.

Mr. Rudy Bayer, applicant, was present to answer questions.

Chairman Brown questioned whether the building would
in fact be rentable given that an office building is doing to
be built on the southeast corner of Mississippi St. and
Silver Lake Road, and also because the 7-11 store has recently
been converted to office space.

Mr. Bayer stated he was very confident about renting the
building as one real estate company from out of state has
expressed an interest in renting the entire building and several
other companies have expressed an interest: in renting portions
of the building. \

Motion by Brown, seconded by Medved, to recommend approval of
LP-58 based on the fact that the application meets all code
requirements.

3 ayes - 0 nayes - carried.
