That the side street yard parking area <br />~_: be re~oved at the time further construction <br />occurs or within five (5) years. <br />5 ayes - 0 nayes - motion carried <br /> <br />Motion by Senden, seconded by Schmidt to approve <br />building permit application LP-l02 subject to <br />the fOllowing conditions: <br /> <br />1. That the final grading and drainage plans are approved <br />by the Rice Creek Watershed District and the City Engineer; <br />2. That the site have three di~veways with the required <br />concrete curbing; <br />3. .That a recordable hold-harmless agreement be executed <br />by the applicant and given to the City holding the <br />City free and clear from any and all claims arising <br />from the construction over the sewer easement and <br />from any claims for damage resulting from necessary <br />sewer repairs by the City or its successors in interest. <br />The agreement shall also provide acknowledgement of <br />the sewer easement and that this permit is limited <br />to the ramp width as shown on the plans and specifications <br />submitted with the application. <br />4.
