RESOLUTION NO. 2360 STATE OF MINNESOTA COUNTY OF RAMSEY CITY OF NEW BRIGHTON RESOLUTION MAKING FINDINGS OF FACT AND APPROVING APPLICATION FOR NON-CONFORMING USE PEIUUT, NC-45 WHEREAS, An application for a non-conforming use permit entitled NC-45 has been made by Micom:~ Inc., to permit the construction of an industrial building on a site with existing Type IV non-conformities; and WHEREAS, The procedural history of the application is as follows: 1. That an application for non-conforming use permit NC-45 was filed \.,ith the City of New Brighton on June -6, 1980. 2. That such application was reviewed by the New Brighton Planning Commission Board of Review on June 17; 1980 and July 15, 1980. 3. That the City Council, pursuant to published and mailed notices, held a public hearing on August 12, 1980, all._ persons present at the hearing were given an opportunity to be heard. , , 4. The written comments and analysis of the City staff, the Planning Commission minutes and recommendations were considered. NOrl THEREFORE BE IT RESOLVED, That the New Brighton City Council makes the following Findings of Fact in respect to NC-45: 1. That the property is zoned 1-2, Heavy Industrial; 2._ That the site has the following Type IV non-conformities A. Less than 401 front yard setback; B. Less than IS' side interior yard setback; C. Less than required side street yard landscaping; D. Side street yard parking; E. Parking within IS' of a street right-of-way; F. Driveway along Old Highway #8 is located less than 501 from the intersection of 'the street right-of-way 3. That under NC-32 approved by the City Council on October 10, 1978 the applicant did everything practical to address the non-conformities and said measures were completed in 1979; 4. That consideration of the non-conformities at a future date could be warranted if such a non-conformity use permit is requested in the future; and BE IT FURTHER RESOLVED, That the application NC-45 is and hereby approved contingent on the following conditions: 1. Conformance with the conditions of NC-32; 2. Conformance with building permit application, LP-l02; and 3.
