<br />'.} <br /> <br />1 0 /1 O?- <br />v\ <br /> <br />HOLD HARMLESS AGREEMENT <br /> <br />.d <br />THIS AGREEMENT, made this / / day of December, 1980, between MICOM COR- <br /> <br />PORATION, a Minnesota corporation, having its principal offices located at 457 <br /> <br />Northwest Eighth Avenue, New Brighton, Minnesota (Micom) and THE CITY OF NEW <br /> <br />BRIGHTON, MINNESOTA (the City). <br /> <br />WIT N E SSE T H: <br /> <br />WHEREAS, Micom wishes to construct a ramp (the Ramp) between two buildings <br />pursuant to plans and specifications submitted with building permit application <br />LP-102 (the Application) given to the City, and located on the property more <br />particularly described as: <br /> <br />The West 150 feet of the South 110 feet of that part of the Northwest <br />1/4 of the Section 29, Township 30, Range 23, lying North of the South <br />1150 feet thereof, and West of the West right-of-way line of <br />Minneapolis, St. Paul and Sault Ste. Marie Railway Co. subject to <br />highways; and a strip of land 3 feet wide by 125 feet long, commencing <br />at the Northwest corner of North 100 feet of South 1150 feet of <br />Northwest 1/4 of Southeast 1/4, Section 29, Township 30, Range 23, <br />lying West of the Minneapolis Sault Ste. Marie Railroad; subject to <br />State Highway No.8, thence in an Easterly direction a distance of 125 <br />feet along North boundary line of said property, thence in a Southerly <br />direction a distance of 3 feet, thence in a Westerly direction a dis- <br />tance of 125 feet, thence in a Northerly direction a distance of 3 <br />feet back to the point of beginning. <br /> <br />That part of the Northwest 1/4 of the Southeast 1/4 lying North of the <br />South 1150 feet thereof and West of the West Railroad right-of-way <br />line of the Minneapolis, St. Paul and Sault Ste. Marie Railway Co. <br />except the South 110 feet of the West 150 feet thereof and the North 3 <br />feet of that part of the North 100 feet of the South 1150 feet of the <br />Northwest 1/4 of the Southeast 1/4 lying West of Railroad right-of-way <br />except the West 125 feet thereof, all in Section 29, Township 30, <br />Range 23, subject to existing highways. (The Property); and <br /> <br />WHEREAS, construction by Micom on the Property will cross over property <br />subject to sewer easement held by the City, granted by Document No. 1582737, <br />recorded January 30, 1963 in Ramsey County, and more particularly described as: <br /> <br />The North 10 feet of the South 590 feet of the West 250 feet of the <br />Northeast 1/4 of Section 29, Town 30, Range 23, and also the East 10 <br />feet of the West 250 feet of the North 400 feet of the South 580 feet <br />of said Northeast 1/4 and also a strip of land 10 feet wide the West <br />line of which is described as follows: Beginning at a point on the <br />East line of the West 250 feet of said Northeast 1/4 of said Section <br />29, 180 feet North of the South line thereof; thence Southwesterly to <br />a point on the East line of the West 150 feet of the Southeast 1/4 of <br />said Section 29, 1250 feet North of the South line thereof and there <br />
