Staff contends <br />that in order to meet the intentions of the non-conforming <br />use permit there are practical measures that could be <br />taken by the applicant. Those measures include: <br /> <br />1. Removing a portion of the blacktop in the front yard <br />on the western portion of the site and install concrete <br />curbing along the western edge of the new drive. The <br />existing blacktop area in the front yard only encourages <br />front yard parking. <br />2. Install sod in the area where the blacktop was to <br />provide more front yard landscaping. <br />3. Comply with the conditions of NC-34 and remove all outside <br />storage of parts and debris. <br />4. Agree to maintain the western portion of the property <br />in the same manner as the other landscpaed areas. The <br />western area to exist in its natural state can be <br />considered too natural. <br /> <br />If these four measures or other similar measures are acceptable <br />to the applicant, the intentions of the non-conforming use <br />permit would be met. In regard to the exterior wall treatment, <br />the applicant is proposing painted standard concrete block <br />for the office building to match the existing building, It <br />would seem inappropriate to require decorative block on the <br />small addition which would not match the existing structure. <br /> <br />BUILDING PERMIT APPLICATION, LP~103 <br /> <br />The plans are complete and contain all necessary information. <br />Consideration of the building permit should be contingent on <br />approval of the non-conforming use permit (NC-46) and approval <br />by the Rice Creek Watershed District. <br /> <br />STAFF RECOMMENDATION <br /> <br />Staff recommends that the Board recommend approval of NC-46 by waiving <br />the reading and adopting the attached resolution with conditions. <br /> <br />Staff further recommends that the Board recommend approval of LP-103 <br />contingent on the following conditions: ' <br /> <br />1. Approval and conformance with non-conforming use permit, <br />NC-43; <br />2. That final grading and drainage plans be approved by the <br />Rice Creek Watershed District and City Engineer; and <br />3.
