<br />., <br /> <br />. <br /> <br />RESOLUTION NO <br />NEW BRIGHTON PLANNING COMMISSION <br />BOARD OF REVIEW <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING APPROVAL OF <br />NON-CONFORMING USE PERMIT NC-47. <br /> <br />WHEREAS, an application for a non-conforming use permit, <br />NC-47 has been made by Cowin and Company, Inc. to construct <br />an addition to an office building on a site with existing Type <br />IV non-conformities, and <br /> <br />WHEREAS, the procedural history of the application is as <br />follows: <br /> <br />1. That an application for a non-conforming use permit was <br />filed with the City on July 7, 1980. <br />2. That the Board of Review heard and reviewed the applica- <br />tion at its regular meeting on July 15, 1980. <br />3. The written comments and analysis of the City Planner <br />and all person's statements made at the Board of Review <br />meeting were considered. <br /> <br />NOW THEREFORE BE IT RESOLVED by the Board of Review that the <br />following Findings of Fact are made in respect to NC-47: <br /> <br />1. That the property is zoned 1-2, Heavy Industrial; <br />2. That there are the following existing Type IV non- <br />conformities: <br />A. Less than requir~d side yard setback; <br />B. Lack of acquired concrete curbing along the western <br />edge of westerly driveway. <br />C. Lack of the required handicap parking spaces (2 are <br />required). <br />D. Outside storage not properly screened form the public <br />right-of-way. <br />E. Lack of required exterior wall treatment. <br />3. That if the applicant conforms with the conditions <br />established in this resolution, the intention of the <br />non-conforming use permit will be met. <br /> <br />BE IT FURTHER RESOLVED That the Board of Review hereby <br />recommends approval of NC-47 subject to the following conditions: <br /> <br />1. That redwood slats be installed in the southern and <br />eastern chain link fence; <br />2. That there be no outside storage of parts, material and/ <br />or debris in undesignated storage areas; and <br />3.
