Lessee covenants: <br />(a) To pay promptly and when due all chafges fOf water, gas, <br />and electric current used on said premises during said term; <br />(b) To keep and maintain all and singular the premises and <br />fixtures in and upon the same in good condition and repair, dam- <br />age by fire, windstorm, or othef unavoidable casualty only except- <br />ed, it being undefstood that the taking of said premises by Lessee <br />shall be conclusive as against Lessee that the premises and the fix- <br />tures in and upon the same were in good and satisfactory condition <br />when possession was taken hereundef; <br />(c) To replace with glass of the same kind and quality any <br />and all glass now or hefeaftef in said premises that may be injured <br />or broken, unless the same shall be broken by fire, Lessee hereby <br />acknowledging that the same is now whole and in good condition. <br /> <br />2. Lessee covenants not to assign this lease nor sublet the whole, <br />Of any paft, of said premises nor permit any other pefson, either <br />jointly with Lessee or otherwise. to occupy the premises, or any part <br />thereof, without fifst obtaining. on each occasion, the written consent <br />of Lessof; said consent shall not be unreasonably withheld; and. <br />should Lessee assign this lease or sublet the whole, or any part. of <br />said pfemises or pefmit any other person, either jointly with Lessee <br />or othefwise, to occupy said pfemises. or any paft thereof, without <br />such written consent, neither acceptance of rent by Lessor from <br />Lessee, Of othef person, thereafter, nor failure on the paft of LeSSOf <br />for any pafticular period to take action on account of such breach or <br />to enforce its rights shall be deemed a waiver of the breach. but the <br />same shall be a continuing bfeach as long as such subtenancy or <br />occupancy continues. <br /> <br />3. Lessee covenants to remove at the termination of said term by <br />lapse of time or otherwise, Lessee's goods and effects and those of all <br />persons claiming under Lessee and peaceably to yield up to Lessor <br />the said premises, and all improvements, alterations, or additions <br />made to or upon the same, in good repaif, order, and condition in <br />all respects. damage by fire, windstorm, or other unavoidable casualty <br />and reasonable use and wear only excepted. <br />4. Lessee covenants that during the said term and such further <br />time as Lessee or any person or persons claiming under Lessee shall <br />hold the premises the same shall not be overloaded, damaged, or <br />defaced, and no trade or occupation shall be carried on upon the <br />same or use made thereof that shall be improper, noisy, offensive, or <br />contrary to any law or ordinance or regulation governing or ap- <br />plicable to said premises for the time being in force, or injuries to <br />any person or property; that no act or thing shall be done upon the <br />said premises which may make void or voidable any insurance of the <br />said premises or building against fire or may render any increased Of <br />extra premium payable for any such insurance; that no rubbish. dirt. <br />or sweepings shall be allowed to accumulate in ~r, ?n sai~ leased <br />premises or be put in the streets or passageways adJommg saId leased <br />premises. but the same shall be removed from the leased premises <br />and from said streets and passageways by Lessee; that Lessee shall <br />not sell nor allow to be sold any intoxicating liquors upon said prem- <br />ises unless the sale thereof is permitted by law and also said premises <br />afe rented fOf such express purpose hereunder, and that Lessee will <br />not do any act or bring any thing in or upon said premises, or the <br />building of which said premises form a part. or the sidewalks. load- <br />ing dock or alleyways adjacent thereto, which will in any way inter- <br />fere with the rights of other tenants in said building or injure or <br />annoy them. <br />
